Two big cities in Orange County switched to district elections this year due to lawsuits filed by Hispanic activists to force the creation of Hispanic-leaning districts. How’d that work out?
In Anaheim, two districts were designated as “Hispanic” districts. Jordan Brandman beat Hispanic activist Jose Moreno in one of them, and Lucille Kring slaughtered leftwing Arturo Ferreras in the other. The upshot – Anaheim will now have seven Caucasians on its council, and no Hispanics.
In Garden Grove, two districts were also designated as “Hispanic”. In one, 23-year old Kim Bernice Nguyen beat Rickk Montoya, who had been the plaintiff in the districting lawsuit. In the other, white neighborhood activist Stephanie Klopfenstein beat LULAC-favorite Demian Garcia-Monroy. Bottom line: Garden Grove goes from a council of three Vietnamese and two Caucasians, to a council of four Caucasians and three Vietnamese, and still, no Hispanics.
In the meantime, in the cities of Westminster and La Habra, which have no district elections, Sergio Contreras and Rose Espinoza were easily reelected.
Just goes to show, if you have good candidates you can win anywhere, while if you have lousy candidates, you can’t force-feed them to the voters anywhere.
By the way, lawsuits to force district elections may soon be a thing of the past. They are all based on the California Voting Rights Act, which virtually demands that cities create districts by race. When new Trump justices join the Supreme Court, the Court could well rule the California Voting Rights Act to be unconstitutional as an illegal intrusion of race into the line drawing process. Are you paying attention, Fullerton and Costa Mesa????

Robyn does not get paid one penny for her work in researching candidates and ballot propositions / measures, putting together her voter recommendations and publishing them on her web site. Plus she is gracious to publish others voter recommendation lists (like my own) even when we make recommendations different from her own. She is a Patriot!

Supervisor’s Chief/Businessowner Andrew Do (R-Westminster), California State Senator Lou Correa (D-Santa Ana), Councilmember/Deputy DA Chris Phan (R-Garden Grove), Television News Anchor Chuyen Van Nguyen (NPP-Garden Grove), and Office Specialist Lupe Morfin-Moreno (R-Santa Ana)
Last night, former Senator Lou Correa (D-Santa Ana) submitted an official request for a recount to the Orange County Registrar of Voters. Judging by recent recount efforts, it is highly unlikely that Correa will be able to overturn Supervisor-Elect Andrew Do’s 43-vote lead.
- In the 2014 general election for the North Orange County Community College District’s Measure J, measure opponents needed to flip 34 votes to block the 55% supermajority to overturn the measure. Realizing a recount would be unlikely to prevail, the opponents went with the unique method of using the recount as an opportunity to examine the provisional ballots, then ended the recount to instead file suit in court to get the provisionals tossed. This case is still pending. However, since provisionals overwhelmingly favored Correa, it is unlikely he would use this method (nor would adding the uncounted provisionals help since there were just a handful of those, so it was far short of 43).
- In the 2014 general election for Mayor of Garden Grove, then-Mayor Bruce Broadwater (D-Garden Grove) sought a recount to overturn his 15-vote re-election loss to then-School Board Member Bao Nguyen (D-Garden Grove). Broadwater threw in the towel when the first day of the recount failed to change a single ballot despite 2,500 ballots being recounted, and Nguyen became Mayor.
- In the 2014 primary election for State Controller, then-Assembly Speaker John Perez (D-Los Angeles) sought a recount to overturn his 481-vote loss to then-Board of Equalization Member Betty Yee (D-San Francisco). Perez gave up after one week when he only managed to change 8 votes in approximately 400 precincts. Yee advanced to the general election against Fresno Mayor Ashley Swearengin and won that race to become State Controller.
- In the 2007 special election for the First Supervisorial District (i.e. the election for this same seat eight years ago when none other than Lou Correa resigned the seat to become a State Senator), then-School Board Member Trung Nguyen (R-Garden Grove) led then-Councilwoman Janet Nguyen (R-Garden Grove) by 7 votes. Janet Nguyen then sought a recount and netted 14 votes, thereby changing her 7-vote deficit into a 7-vote lead. Trung Nguyen then went to court and widdled Janet Nguyen’s lead down to 3 votes. Janet Nguyen, of course, went on to serve eight years in the seat before resigning in 2014 to become a State Senator, triggering the 2015 special election. One important caveat in this story, state laws regarding recounts were much more generous in allowing ballots to be tossed back then, and even that was only a 14-vote (or 11-vote if you consider the judge’s rulings) switch.
Do’s 43-vote victory is simply too large a margin for Correa to overcome. I don’t blame Correa for trying, because 43 votes out of 48,626 cast in 101 precincts is tantalizingly close, but he just won’t be able to pull it off.
Do will be sworn in as Supervisor this morning.

It was brought to my attention recently that the Lou Correa campaign for Supervisor had hung a large campaign sign at Santa Ana Valley High School. I wrote about it here
I received many calls and text messages alerting me to other signs hung on public property such as schools, parks and flood control channels.
Pictured above is another shameful example of the disrespect afforded taxpayers.
Why would the Lou Correa campaign hang this sign at Santa Ana’s Godinez High School after it was revealed the sign at Valley was illegal?

Yesterday, the recount in the Garden Grove Mayor’s race began and ended. After recounting 2,679 ballots in 10 precincts (of which 2,515, or 93.9%, cast a vote for Mayor), not a single ballot changed, so the original count remains:

After counting approximately 1/10 of the vote and getting no changes, Mayor Bruce Broadwater, who initiated the recall, threw in the towel.
Consequently, Garden Grove Unified School District Trustee Bao Nguyen (D) unseated Mayor Broadwater (D) by 15 votes.

A long-term fixture in Garden Grove politics who served as either Mayor or Councilmember for 20 of the last 22 years, Broadwater had been Mayor for six nonconsecutive terms (1994-2004, 2012-2014) and served three terms on the City Council (1992-1994, 2006-2012). A union organizer by profession, Nguyen was appointed to the Garden Grove Unified School District Board of Trustees in 2011 and elected to a full term in 2012.
Broadwater’s final Council meeting will be tonight. Nguyen’s first Council meeting will be December 9. The Garden Grove Unified School District has 60 days to appoint a new Trustee to complete Nguyen’s term, which expires in 2016. Should they not appoint in 60 days, they will trigger a special election.
It is not legally possible to consolidate a Garden Grove Unified School District special election with the First Supervisorial District special election to replace Supervisor Janet Nguyen (R) who was elected to the Senate. The Education Code specifies that a special election to fill a school board seat must be at least 130 days after the Board calls the special election. The County Charter specifies that a special election to fill a Supervisor’s seat must be no later than 70 days after the vacancy occurs. The Election Code specifies elections must always occur on a Tuesday.
For the sake of argument, had Bao Nguyen resigned on Election Day, and the school district called the special election as fast as possible after that, the earliest legal date for a Garden Grove Unified School District special election would be Tuesday, March 17, 2015. If (as expected), Janet Nguyen remains a Supervisor until she is sworn in as a Senator on December 1, the latest legal date for a First Supervisorial District special election would be Tuesday, February 3, 2015.
Considering Bao Nguyen was originally appointed to the Garden Grove Unified School District Board of Trustees, it seems likely that the school board would appoint again rather than go to special election. The scenarios that would cause a special election would be if the school board failed to appoint (i.e. no individual candidate could obtain three votes from the Board) or if 1.5% of voters petition to invalidate the appointment (i.e. the scenario that caused the bizarre Irvine Unified School District special election that resulted in Ira Glasky (R) becoming quite possibly the first person ever to be sworn in to the same office three times in a twelve-month period: at his appointment in late December 2013, after his special election in June 2014, and again in early December 2014 after the November 2014 general election).
Will former Garden Grove Unified School District Trustee Trung Nguyen (R) seek the appointment? Three of the four trustees served with Nguyen on the Board while the fourth was elected to fill his vacancy in 2008.
- Readers may recall that in the 2007 special election for First District Supervisor to replace Lou Correa (D) who was elected to the Senate, Trung Nguyen led Janet Nguyen in the initial count by seven votes. After the recount, the lead flipped, and Janet Nguyen led Trung Nguyen by seven votes. Then after going to court, the lead shrunk, and Janet Nguyen was elected Supervisor over Trung Nguyen by three votes.
- Trung Nguyen then made an ill-fated bid for Garden Grove City Council in 2008, losing by nearly 3,000 votes (or 3.7%) to Andrew Do (R), Janet Nguyen’s Chief of Staff. Trung Nguyen gave up his school board seat, as it expired in the same 2008 election.
- Then, in this month’s elections, Trung Nguyen made an ill-fated bid to unseat incumbent Rancho Santiago Community College District Trustee Larry Labrado (D), losing by more than 2,400 votes (or a whopping 25.7%).
With Nguyen expressing interest in returning to an education seat after a six year absence, will his old colleagues reappoint him, or will they seek new blood?
Cue Nguyen disclaimer: Senator-Elect Janet Nguyen, Mayor-Elect Bao Nguyen, and former Trustee Trung Nguyen are not related to each other, and none of them are related to me. The last name Nguyen is held by 36% of Vietnamese people.

In the era of term limits, many City Councilmembers run for higher office while others seek to extend their political lives by running for lower office. As we peer into candidate filing, there are at least three City Councilmembers are exercising the option to do the latter.
La Palma City Councilman Henry Charoen, Garden Grove City Councilwoman Dina Nguyen, and Newport Beach City Councilwoman Leslie Daigle
- La Palma City Councilman Henry Charoen has pulled (and filed) papers for the Centralia School District
- Garden Grove City Councilwoman Dina Nguyen has pulled papers for Orange County Water District, Division 1
- Newport Beach City Councilwoman Leslie Daigle has pulled papers for Orange County Water District, Division 5
Charoen and the Centralia School District
Charoen (R) is prepared for this campaign for Centralia School District, transferring nearly $30,000 into his school board account from his Assembly account after he opted not to seek the AD-65 seat. $30,000 pays for a lot of voter contact in a district as tiny as Centralia, plus he has significant name ID in the La Palma portion of Centralia. He also teaches at UCI. At this point, Charoen is the only one who has actually filed.
Incumbent Lisa Jordan (R) has pulled papers, as has appointed incumbent Kevin Sequeira (R). 73-year-old incumbent Irv Trinkle (R) has not pulled papers, and I’ve heard conflicting rumors about him, with some saying he’s retiring and others saying he’s running for re-election (Trinkle’s campaign web site was last updated in the spring).
Former Centralia Board Member Art Montez (D) pulled papers for both Centralia and the Buena Park Library District. Jordan beat Montez by 64 votes in 2010 when Montez was an incumbent. Montez lost by 5% in 2012 in an unsuccessful bid to return to the Board. If Montez files and loses for a third consecutive time, he risks going from former Board member to perennial Board candidate. He has to either sit this one out or win his old seat back in order to avoid that fate. He probably shouldn’t file for both the Centralia School District and the Buena Park Library District, lest he suffer the fate of former Water Board Director Douglas Chapman, who lost both races when he ran for two seats in 2012.
Though an experienced field of elected officials have pulled papers in Centralia, the first person who pulled papers was 20-year-old Chapman University student Connor Traut (D) who moved to Anaheim a few months ago from Ladera Ranch, where he was a member of the Ladera Ranch Civic Council. Traut is an acolyte of Anaheim Councilman Jordan Brandman (D). (Brandman allies seem to be popping up in different Anaheim school board seats, as D.R. Heywood (D) has pulled papers in the Anaheim City School District.)
Nguyen and Orange County Water District Division 1
Nguyen (R) appears to be unopposed for the Division 1 seat in the Orange County Water District.
In total, the OCWD Board has ten members: seven directly-elected and three appointed by City Councils (Anaheim, Fullerton, and Santa Ana). Incumbent Kay Barr is the only directly-elected Democrat on the OCWD Board. The other six directly-elected members are Republicans. Of the three appointed positions, Anaheim appointed Harry Sidhu (R), Fullerton appointed Jan Flory (D), and Santa Ana appointed Vincent Sarmiento (D).
Barr is retiring, and Nguyen is the only candidate who has pulled papers. Dina Nguyen made an ill-fated bid for Orange County Supervisor against Janet Nguyen (R) in 2008. Barr and both Nguyens served on the Garden Grove City Council: Barr from 1962-1970 and 1974-1978, Janet Nguyen from 2004-2007, and Dina Nguyen from 2006-present. Barr has been an OCWD Board Member since 1979. At 35 years, Barr’s exit ends the longest tenure by a single person in the 81-year history of OCWD.
(For the record, I am not related to either Dina Nguyen or Janet Nguyen. The last name Nguyen is held by 36% of Vietnamese people.)
Daigle and Orange County Water District Division 5
Daigle (R) is challenging incumbent Orange County Water Board Member Steve Sheldon (R). Sheldon was appointed to the OCWD Board in 2005 and won 71% of the vote in his 2006 bid for a full term against termed out Newport Beach City Councilman Tod Ridgeway (R). Presumably, Daigle does not plan to suffer the same fate as Ridgeway. She does have significantly higher name ID than Ridgeway did thanks in part to her ill-fated run for AD-74 when she challenged Allan Mansoor in 2012. She fared slightly better in OCWD Division 5 than in the rest of the district, winning 25.3% of the vote (as opposed to her districtwide total of 23.8%).

Today, Orange County Supervisor Janet Nguyen releases statement in response to the Democratic Party of Orange County Chairman Henry Vadermeir for politicizing an important issue:
“It is sad that the Democratic Party would attempt to politicize an issue that is so important to so many local people in need of quality health care.
It’s curious that their alleged interest in the program appears in the middle of a political campaign and clearly shows they don’t understand the issues important to the 34th Senate District.
What’s worse is that the local Democratic operatives who issued this release are either ignorant of the facts or purposefully distorted the facts surrounding CalOptima.
They falsely stated that Supervisor Nguyen is the Chair of CalOptima, got the number of CalOptima patients wrong, inaccurately stated that the audit will take years to complete, and conveniently left out the fact that the audit was a routine, standard audit not caused by any one person’s actions.
Supervisor Nguyen stands by her actions to reform CalOptima because they were necessary to ensure transparency, accountability and quality services for the county’s most vulnerable population”
Orange County Democrats are conveniently running away from Obamacare and will do anything to politicize an issue such as CalOptima.
Orange County Democratic Party Chairman should be ashamed of himself!

I was working on a database of the part affiliation of all Orange County local elected officials. Finally, I have completed the project with all of the special districts and county seats being added. I also fixed some errors in the previous versions (here, here, and here) and have combined the database into one post.

This evening the Garden Grove City Council will be discussing an item that would reduce the amount of time for public comment.
Staff reports state “An inordinate amount of time is devoted to public comment, often of a repetitive nature.”
The Council seeks to cut the time per speaker from 5 minutes to 3 minutes.
I’ve heard from several residents and community leaders who state that they plan on objecting to the proposal at this evenings meeting which starts at 6:30.
Do you think the Council will place limits on speakers or find a better way to do the people’s business without limiting the people’s input?
