Sacramento Saga Continues: U.S. Attorney subpoenas Senator de León

OC Political reported breaking news on Tuesday regarding Senator Ron Calderon (D-Whittier) office was raided by the FBI.

My colleague Chris Nguyen elaborated with an article following up the breaking news about Senator Calderon and the FBI raid.

Now, it is reported by the Sacramento Bee that U.S. Attorney has subpoena Senator Kevin de León (D-Los Angeles).

In a statement, Senator de León said he received a subpoena on Thursday.

The Sacramento Bee reports that Senator de León intended “to cooperate fully” and will be interviewed by a grand jury in July.

As the saga coming out of Sacramento continues OC Political will be on top of the story to bring you the latest updates.

Big Labor’s Power Grab In Orange County Does Not Equal Worker Protection

Big Labor’s power grab in California is more aggressive than ever. It is even creeping into Orange County. In just the past year, we have seen unions try and pass several discriminatory Project Labor Agreements (or PLAs) that virtually guarantee that all of the work will be limited to the 16% of the California construction market that is union. This week, the Coast Community College District rejected a PLA, but the unfair special interest deals are still pending at Rancho Santiago Community College (thanks to Jose Solorio) and at the Naval Weapons Station in Seal Beach (thanks to Obama.) We even saw unions fighting against local control in Newport Beach and the Orange County Fairgrounds (Thanks Jerry Brown for appointing union boss Nick Berardino. The Fair policy now even discriminates against non-union veterans certified in the military.) And of course unions dumped nearly a half million dollars of their special interest money from out of town to defeat the Costa Mesa 2012 City Charter.

In every public comment debate on these Orange County issues, the unions always claim that they are pushing for their virtual monopoly on the work so that they can protect workers and make sure they are not exploited by evil capitalists trying to skirt labor laws. But as you can see from the number of violations that were discovered and reported to LAUSD’s labor compliance program and the Division of Labor Standards Enforcement, union work does not equal regulatory compliance. In fact, after months of inactivity by both entities, CCCG took dramatic action and requested revocation of LAUSD’s labor compliance program since they would not do anything about the 70 cheated construction workers owed over $91,000 in back wages.

It seems the unions don’t monitor their union “brothers” too well. Shocking, I know. Maybe more shocking is that unions are now pushing a bill in the State Senate to allow ONLY UNION PROGRAMS TO MONITOR LABOR LAWS! Earlier this month, on May 9, 2013, SB 776 passed 24-10 off Senate Floor with bipartisan opposition – including OC Democrat State Senator Lou Correa who voted against it. Hopefully more moderate Democrats will realize that letting the fox guard the henhouse isn’t good for quality building or for worker protection. Here is the full press release on the violations:

70 Cheated Construction Workers Win Over $91,000 in Back Wages, CA Senate Still Votes to End Program

Sacramento – On May 9, 2013, SB 776 passed 24-10 off Senate Floor with bipartisan opposition. It now moves to the California State Assembly. SB 776 would change the current law, so that only union-controlled worker protection programs exist – eliminating the California Construction Compliance Group (CCCG.)

Ironically, as a result of an CCCG labor compliance audit, the Los Angeles Unified School District recently collected over $91,000 in unpaid wages owed to The Masonry Group California, Inc. employee’s who perform work on the Valley Region High School Number 5 project. The beneficiaries of the settlement include over 70 workers of the now defunct The Masonry Group, a company that is currently in Chapter 7 Bankruptcy.

In 2010, ABC-CCC dba CCCG performed an audit of construction contractor compliance the LAUSD’s Valley Region High School Number 5 project. A number of violations were discovered and reported to LAUSD’s labor compliance program and the Division of Labor Standards Enforcement. After months of inactivity by both entities, CCCG took dramatic action and requested revocation of LAUSD’s labor compliance program. The revocation request got LAUSD’s labor compliance program moving and CCCG’s complaints and audits were properly investigated. After investigation of The Masonry Group’s practices and years of litigation, LAUSD was able to recover $91,688.98 in back wages, $2,181.27 in training fees and $28,950.00 in penalties. Because The Masonry Group seemingly disappeared, Turner Construction, the general on the project, was the party that ultimately made things right for the underpaid employees.

As acknowledged in the June 27, 2011, Request for Approval of Forfeiture & Penalties from LAUSD Labor Compliance Officer Nancy Morada to the Susan Nakagama of the DLSE Bureau of Field Enforcement, it was CCCG’s complaint that prompted the investigation of The Masonry Group:

In the words of John Loudon, Executive Director of the California Construction Compliance Group, “Without our efforts, these gross underpayments would have been undetected. This is a great day for these workers who did the work and were severely underpaid in violation of the law. We appreciate that LAUSD and Turner Construction were able to work out a reasonable settlement. Sadly, Turner is stuck holding the bag for the misdeeds of The Masonry Group. I hope that Turner is ultimately able to get justice through the system and make the guilty party pay”.

“In a strange irony, we received word of this victory the same day Senator Ellen Corbett, at the bidding of organized labor unions, passed SB 776 out of the California Senate. This bill is designed to bar us from monitoring and enforcing prevailing wage laws. I wonder whether these workers support the move the union bosses are pushing,” said Loudon.

The Munger Games: Bob Huff and Connie Conway – No Criticism of Munger For You!

This weekend, delegates to the California Republican Party Convention will travel to Sacramento will vote on a new Chairman, Vice Chairman and several other important CRP board positions. Since the current Chairman, Tom Del Beccaro, has announced he will not be running for re-election, former legislator Jim Brulte has stepped up to take the Chairman position in what can easily be described as the CRP’s lowest point in a generation. Senator Brulte has only drawn the token opposition of a very late entrant into that race and it appears Mr. Brulte has all but locked up the position. We wish him well in what will be a difficult job.

The real drama is surrounding the continued and expanding influence of Silicon Valley billionaire and Santa Clara County Republican Central Committee Chairman Charles Munger, Jr. As readers of this blog post know, Mr. Munger spent millions of dollars in last year’s election. Some of it was to support Proposition 32 and oppose Proposition 30. Unfortunately Prop. 32 failed and Prop. 30 passed.

Also unfortunately, Mr. Munger attempted to oust Assemblyman Allan Mansoor by spending hundreds of thousands of dollars in support of Allan’s June 2012 Republican opponent Leslie Daigle of Newport Beach. Thankfully that effort failed but Mr. Munger continued forward by spending more hundreds of thousands of dollars in the fall campaign in Republican v. Republican races. It is too bad he could not have spent even a little of that money to help Republicans in Republican v. Democrat races so that the State Senate and Assembly might not be in the complete control of Democrats for the next legislative session. The Chris Norby Assembly race comes to mind.

Recently, State Senate Republican leader Bob Huff and Assembly Republican leader Connie Conway sent out a letter / e-mail to CRP Delegates defending Charles Munger and criticizing those who criticize Mr. Munger. It is noted that during the run up to the race between Allan Mansoor and Mr. Daigle, Mr. Huff and Ms. Conway did little or nothing to help Allan beat off this obvious challenge to a sitting Assemblyman that could have resulted in a Democrat running in the fall runoff against a non-incumbent weaker Republican Daigle for that seat. A pause here to give mega kudos to Orange County OC GOP Chairman Scott Baugh (and hundreds of volunteers) who pulled out all stops in support of Assemblyman Mansoor!

A web site/blog called The Munger Games, which appears to be one of the objects of Mr. Huff’s and Ms. Conway’s wrath, responded to their letter by pointing out they’re defending a man who wasted resources attacking a sitting Assemblyman while being a sitting Chairman of another county’s Republican Central Committee. The blog also pointed out that debates and criticism are important to the political process and the voters of Allan Mansoor’s district certainly expressed their views by reelecting Allan by such a wide margin that Ms. Daigle did not even make it into the “top two” runoff – the new system brought to you by Proposition 14 – again courtesy of Charles Munger, a very big supporter financially of Prop. 14.

Bottom line: The Munger Games blog site asks some very, very important and legitimate questions Senate Republican leader Bob Huff and Assembly Republican leader Connie Conway should answer. Whether or not they agreed with Mr. Munger’s attempt to unseat a sitting Assemblyman at the risk of placing that safe Republican seat in play for the Democrats? If the resources Allan had to raise to fend off that challenge and the resources Mr. Munger used for that race and the R v. R races he spent money on in the fall could have been better spent holding onto Republican seats? Where were they during that June primary battle while Allan was fighting for his political life? Why are you attacking those who are asking these important questions? Why are you attacking those who engage in an honest debate by bringing up these issues?

This blog post writer would like to know the answers to those questions too. Senator Huff what is your response to those questions? Assemblywoman Conway?

Supervisor Janet Nguyen to Run for State Senate with Support of the Senate’s Republican Leaders

GARDEN GROVE, CA — Orange County Supervisor Janet Nguyen today announced that she will be a candidate for State Senate in the new 34th district and that she had already secured the support of the Senate’s Republican leaders, including Senate Minority leader Bob Huff and Senate Republican Caucus Chairman Ted Gaines. Nguyen currently represents 60% of the 34th district as a County Supervisor.

“The people of our area work hard to build a better life for themselves and their children,” said Nguyen. “They care about our schools, the local economy and the safety of their neighborhoods. They want and deserve results and care little about the partisan debate in Sacramento.”

Nguyen said that her priorities for the district are to make sure local schools are fully funded, give tax and regulatory relief to small businesses, increase public safety and make sure that seniors maintain access to quality health care. She says the state legislature needs to reduce waste, control spending and concentrate on growing the economy and bringing jobs back to the state.

“Janet Nguyen is a public servant who works tirelessly for the people of her district. She will be a great addition to the State Senate and I am pleased to endorse her,” said Senate Minority Leader Bob Huff.

“Last year, California voters chose to raise taxes. Now we need more responsible representatives in Sacramento who will use those new funds wisely, balance the state budget and not keep coming back to hard working Californians looking for more,” said Nguyen.

State Senator Mimi Walters called Nguyen the ideal candidate for the 34th district. “Janet knows what it takes to run and win tough campaigns because she has done it time and time again. She is a tenacious campaigner and a dedicated public servant,” said Walters.

The 34th district contains the heart of Orange County and all of the area known as Little Saigon. Over 90% of the registered voters in the district live in Orange County, with the remainder in Long Beach.

Janet Nguyen was elected to the Orange County Board of Supervisors in February, 2007. In doing so, she became the first Asian-American and the first Vietnamese-American to serve on the Board of Supervisors, and the youngest Supervisor ever to be elected in Orange County. In 2008, Nguyen was honored by Latino OC 100 for her contributions to the Latino community. Janet previously served on the Garden Grove City Council and as Vice President of Government and Public Affairs for the Long Beach Area Chamber of Commerce. Janet, her husband and children live in Garden Grove.

During her tenure as a County Supervisor, the County has maintained a balanced budget every year while also being able to set aside money into the reserve. The County of Orange restructured its Retirement Medical and Pensions Programs, resulting in savings of $992 million to the County’s unfunded liability.

As part of an effort to reclaim local neighborhoods from the control of gangs, Janet joined the Orange County District Attorney’s Office and local law enforcement agencies to obtain a permanent gang injunction against local criminal street gangs.

SD-34: Long Pham Officially in the Race

In case you weren’t following every word of my live blog, former Orange County Board of Education Trustee Long Pham is officially jumping into the SD-34 race.

Just last week our blogger, Dominus, covered SD-34 and speculated on the possibility of a Pham candidacy. Other likely SD-34 Republican candidates are Supervisor Janet Nguyen and former Assemblyman Jim Silva. Rancho Santiago Community College District Trustee and former Assemblyman Jose Solorio will likely represent the Democrats, though Garden Grove Planning Commissioner Joe Dovinh may jump in.

More on this in the coming weeks and months ahead, but it’s clear the SD-34 games have begun.

SD 34 Watch: Could be a Crowded Field

Even though the 2012 Presidential Election just ended a few months ago, many candidates are already putting the pieces together for the next campaign.

In 2014, I suspect there will only be two competitive state legislative races in Orange County: SD 34 (Correa) and AD 65 (Quirk-Silva).  In this post, I will focus on SD 34 and save AD 65 for another day.

By any standard measures, SD 34 is a swing district.  Democrats outnumbered Republicans by less than a percentage point.  The district voted heavily in favor of Proposition 8.  The incumbent Lou Correa is termed-out in 2014.

Here is my analysis of this race:

REPUBLICAN FIELD

The most active candidate on the Republican side is Supervisor Janet Nguyen.  She started plotting for this seat back in 2011 when she endorsed Long Beach Councilman Gary DeLong for Congress over Los Alamitos Councilman Troy Edgar in exchange for the support of LA Supervisor Don Knabe.Janet-Nguyen-and-Baby-Tom-300x227

You may wonder why is the support of Don Knabe important? It is because the new SD 34 have a sizable portion of Los Angeles.

Janet also lucked-out when then-campaign treasurer Kindee Durkee cleaned out the accounts of Senator Lou Correa and Assemblyman Jose Solorio.  One of these two politicians were supposed to challenge Janet in 2012.  Instead, the 1st District Supervisor faced a token candidate and didn’t have to spend a whole lot of money for her re-election.  Janet could be sitting on $300,000 – $350,000 right now.

Another Republican candidate in this race is former Assemblyman Jim Silva.  I say potential because Jim is still wishy-washy about it.  Sure he is sitting on top of $400,000 but the idea of running in a brutal primary then go through a general election doesn’t sit well with Jim.  If anything, Jim wants to be drafted by the GOP establishment to run.

Jim may end up running after all, depending on the field.

Aside from these two Republicans, we have another one thinking about it – Long Pham.  The former Orange County Board of Education member and nuclear engineer who spent $100,000 of his personal money on a failed assembly campaign is talking to people about a potential run for SD 34.  Long have loyal followers in the Vietnamese community.  He just need to hire a better campaign consultant if he is to make another run at public office.

DEMOCRATIC FIELD

The front runner on the Democratic side is Jose Solorio, a trustee of the Rancho Santiago Community College District.  As a government consultant, Jose will have plenty of time and flexibility to campaign in this district.  I’m not sure how much money he is sitting on but financial resources should not be a problem if Jose is the only Democrat in the race.  Money from Sacramento will just flow into this war chest.Jose-Solorio-in-Sacramento

Jose’s best bet is to make it into the general November election where more Democrats are likely to vote.  Currently, I see a big problem for Jose – the person he is trying to succeed.

It is in Lou Correa’s interest to have Janet win the 34 SD in 2014 so that it will trigger a special election in 2015 for her supervisorial seat.  Lou and his staff will work behind the scene to help Janet (they can’t do it publicly).

The other Democrat in this race is former Garden Grove planning commissioner Joe Dovinh.  Joe likes to run.  Does he have a chance of winning? Sure, if he can make it through the primary with a Republican opponent.  It’s going to take a lot for Joe not to run and Janet knows it.

Later this week I will write about AD 65 and the likely Republican contender for this seat against incumbent Democrat Sharon Quirk-Silva.

Greg Diamond Says He’s Running For Congress, Gets Assistance From Fly By Night Karma Repair, And Pays 20% Fundraising Commission To Household Member For Out-Of-District Funds

In his July, August, September campaign finance report, Democrat Senate candidate Greg Diamond raised $2,560 for the period, and he paid $500 to a fundraising consultant.  Why would anyone pay a 20% fundraising commission when the normal commission is 10%-15%?

Maybe it’s because he’s paying it to a person who lives in his house.

That’s right, Greg Diamond campaign donors, you’re contributing to a campaign who’s sending money straight into the candidate’s household’s pockets.

Although since his donors are largely from outside the district, I guess they wouldn’t really notice.  Of his $1640 itemized contributions, there is exactly one from the 29th Senate District: $100 contribution from former Assembly Democrat Sacrificial Lamb John MacMurray.  Even widening the net to all of California south of San Francisco, there’s only two more: a $50 contribution from Garden Grove and a $25 contribution from Glendale.  All of California only adds one more $250 contribution from El Cerrito (north of Berkeley) from the CEO of Fly by Night Karma Repair.  Yes, he’s reporting $250 from the CEO of something called “Fly by Night Karma Repair.”

His contributions are from so far out of the district that he even got $500 from a foreign country.  Weirdly, that’s the same amount he paid to the fundraising consultant living in his house.

Diamond opposes Proposition 35, which according to its official summary on the ballot, “Increases prison sentences and fines for human trafficking convictions. Requires convicted human traffickers to register as sex offenders. Requires registered sex offenders to disclose Internet activities and identities.”

Of course, I should note that it could be that the donors didn’t know what office Diamond was running for.  I’m not sure he does either.  Check out his web site’s “About Why I’m Running” page at http://www.gregdiamond2012.com/aboutwhyirun, where Diamond says, “I decided to run for Congress because, among the people in the Occupy movement here, I’m among those who could most easily be considered a credible potential candidate.”  There is so much silliness in that one sentence.

I wonder how Ed Royce and Jay Chen feel about Diamond’s Congressional campaign.

Greg Diamond: Getting Support From All The Wrong Places

Donations to Greg Diamond for SenateI’m going to be looking over the campaign finances of various sacrificial lambs in the coming days and weeks for no particular reason other than their finances are humorous.

First up, I’ve been looking over the campaign finance report of March 18th to May 19th of State Senate candidate Greg Diamond, who is running in Senate District 29 against incumbent senator Bob Huff. Diamond’s campaign ended the period with a cash balance of $5,511. Thumbing through Diamond’s $5,401 donations reveals something strange: virtually all of his money comes from outside the district, and half of it comes from outside California! Of his total haul, $3,125.04 was in itemized donations, meaning the other $2,275.69 came in increments under $100. Diamond’s donor base is a virtual tour around America:

  • $100 from Illinois
  • $100 from Virginia
  • $100 from Maryland
  • $100 from Massachusetts
  • $200 from Minnesota
  • $375 from New Mexico
  • $500 from Florida

There was even $100 donated from Switzerland! He did raise $1450.04 from Californians outside Senate District 29. The only contribution from the district: $100 from a government employee who lives in Placentia! Diamond raised an equal amount from his district as he did from Switzerland! One might ask: What makes these people scattered across the country, and even this individual in Switzerland, want to donate to a long-shot California State Senate race? Has anyone ever heard of a campaign where only 1.9% of the donations came from within the district?

Sure, a campaign dollar from Placentia will get spent the same as a campaign dollar from Switzerland or Massachusetts, but shouldn’t there be more than $100 in district money in a campaign?
