AD-69: Moreno Drops Out Citing Hatch Act, Name Will Remain on Ballot

In case you hadn’t read the other blogs (like Liberal OC or Orange Juice) yesterday, Republican 69th Assembly District candidate Jose “Joe” Moreno announced that he was dropping out of the AD-69 race because of the Hatch Act.

While the timing is surprising, this development itself should not be of surprise to anyone:

  • On March 29, Moreno wrote to the Registrar of Voters attempting to withdraw from the AD-69 race, citing the Hatch Act.  (The Registrar denied this request.)
  • In the second week of April, OC Political, the OC Register, the Liberal OC, and then OC Political again speculated/warned/advised that Moreno’s candidacy likely violated the Hatch Act.
  • On April 21, Moreno issued this press release declaring his candidacy was not in violation of the Hatch Act.
  • On April 23, the Liberal OC again wrote that Moreno’s candidacy violated the Hatch Act.
  • On July 18, unbeknownst to the OC mainstream media and blogosphere, the U.S. Office of Special Counsel issued an advisory opinion, entitled “California’s Voter-Nominated Primary Elections are Presumptively Partisan for Purposes of the Hatch Act.”

In that July 18 advisory opinion, the U.S. Office of Special Counsel  stated:

In short, California’s voter-nominated elections are presumptively partisan elections for purposes of the Hatch Act. As such, an SSA employee covered by the Hatch Act may not be a candidate in voter-nominated primary elections.

The advisory opinion also states:

…even if voter-nominated elections were designated nonpartisan by the California Constitution, and therefore presumed nonpartisan for purposes of section 1503, the presumption would be rebutted. The California Constitution allows candidates in the voter-nominated primaries to list a party preference following their names on the ballot…

Though the advisory opinion is redacted, it’s fairly obvious that this was the advisory opinion requested regarding Moreno.  There are only 306 candidates running in a California voter-nominated race in November (2 each for the U.S. Senate, for 53 U.S. House races, for 20 State Senate races, and for 78 Assembly races, plus Assemblywoman Susan Bonilla (D-14) and Assemblyman Isadore Hall III (D-64), both of whom are unopposed).  Moreno is the only one of the 306 to work for a Social Services Agency.

(One interesting footnote in the advisory opinion:

Arguably, if in a particular voter-nominated primary election all of the candidates were to run without designating a political party as their party preference then the election could be considered a nonpartisan election for purposes of section 1503 of the Hatch Act.

So a bunch of NPPs running could technically make the race nonpartisan for purposes of the Hatch Act.)

In April, OC Political had noted the case of Geof Lickey, who was able to get off of the June 2012 ballot for the AD-31 seat due to the Hatch Act because he acted more quickly than Moreno did.

The fifth commenter on this June post from Liberal OC pointed to the case of Judge Ronald Kline, who withdrew in the tiny window after the primary but before certification of the election.  The courts eventually ruled that third-place finisher Gay Sandoval would replace Kline on the November runoff ballot.  (John Adams, who had originally won the right to face off against Kline, defeated Sandoval.)

Had Moreno or the Orange County Social Services Agency moved more quickly to seek an advisory opinion from the U.S. Office of Special Counsel back in April, Moreno’s ineligibility could have been discovered sooner, and he could have withdrawn during the primary.  Considering Moreno only edged out Julio Perez by 242 votes, it is not inconceivable that more than 242 voters had Googled the race and discovered that Moreno’s press release or the various blog posts (such as this one from Orange Juice) in which he declared as lies the Jobs PAC IEs on behalf of Daly that claimed Moreno had dropped out (I believe his claim was also posted on his web site before he took it down).

Or if Moreno had withdrawn before the June primary was certified, voters in AD-69 would have had a choice between first-place finisher Tom Daly and third-place finisher Julio Perez.  Due to Prop 14, voters don’t even have the choice of a write-in candidate, so this late withdrawal leaves AD-69 voters with the choice of Daly or the withdrawn Moreno.

While this was Moreno’s first run for partisan office, this was not his first time throwing his hat in the political ring.  According to JoinCalifornia, Moreno had previously run unsuccessfully for Orange County Board of Education (2000 primary), Rancho Santiago Community College District (2000 general), and Anaheim Union High School District (2010 general).

We are now left with just two questions: Will Moreno resign his ex officio seat on the Republican Central Committee?  What will Garden Grove Councilman Steve Jones do about his endorsement flip-flopping between Democrat Daly and Republican Moreno.

Dr. Ken Williams and Robert Hammond Sworn in as Trustees for the Orange County Board of Education

Today I had the honor of attending the swearing in ceremony of Dr. Ken Williams and Robert Hammond for their terms on the Orange County Board of Education. For those who are already familiar with the OCBOE, you know that Dr. Ken Williams has been a conservative voice on that Board for many years. I was glad that Dr. Williams not only won re-election but by a large majority of those voting in his Trustee area.

Robert Hammond is the new comer to the Board having just won his election on June 5th. Robert had a tough race against several opponents but he worked very, very hard to reach out to the voters in his Trustee Area and it paid off in his win on Election Day. Robert will be a strong conservative voice on this Board and I am encouraged by his election as a Republican in an area that has many Democrats and Decline to State voters.

What might not be so well known is our publishers Chris Emami and Chris Nguyen of Custom Campaigns were the campaigns managers for both Dr. Williams and Mr. Hammond. They did a great job of planning and executing successful election and re-election campaigns on shoe string budgets. With these two successes and their past successes with other school board races, Custom Campaigns is becoming the go to group for getting elected to a school board in Orange County.

Is it time to shut down the OC Board of Education?

Have you ever stopped to think about all the redundancy in the educational system?

US Department of Education, California Department of Education, Orange County Board of Education and 28 local school districts/Boards just in Orange County alone.

Is it all really necessary?

Does it really help the children?

With all the talk about local control, charter schools and voucher programs, what if we dissolved the OC Board of Education and distributed their 214 Million annual budget among the 28 local school districts in Orange County?

Bill Habermehl Retirement Details

The details have now been found on the retirement of Orange County Department of Education Superintendent Bill Habermehl. A press release has become available on the OCDE website:

ORANGE COUNTY SUPERINTENDENT OF SCHOOLS WILLIAM M. HABERMEHL ANNOUNCES RETIREMENT

COSTA MESA, CALIFORNIA, MAY 3, 2012 – At the Orange County Board of Education Meeting today, Orange County Superintendent of Schools, Bill Habermehl announced his retirement effective June 29, 2012.

“It has been a great honor and privilege to have served as superintendent of this exceptional county,” said Habermehl, who has been in public education for 45 years – the past 11 years as Orange County Superintendent of Schools. “I have had the opportunity in this position to work with outstanding staff, educators, board members, parents, and community members who are doing incredible work for the students of Orange County. I will miss everyone very much, but I know that I am leaving this office in good hands, and I am confident that our youngest citizens will continue to receive world-class educational services.”

Habermehl was appointed by the Orange County Board of Education in April 2001 and successfully stood for election in 2002, 2006, and again in 2010. Prior to serving as County Superintendent, he served in several positions at the Orange County Department of Education, including Director, Assistant Superintendent, and Associate Superintendent. He began his career as a science teacher and football coach in Garden Grove Unified School District, and he served as an administrator in Fullerton Joint Union High School District.

Under Bill’s leadership, he has supported the Orange County Department of Education to create or expand the development of many world-class educational programs, to name a few:

Habermehl has a biography available for view on the Department of Education website that focuses on his work as a speaker, host, and moderator. It was not the easiest biography to find and it needs a bit of cleaning up, but that is a moot point now:

Bill Habermehl is the county superintendent of schools for Orange County California. With his wealth of experience at the local, state and national level he has developed an understanding of what an audience wants from an outstanding presentation.

Bill began his career as a science teacher and football coach in Orange County California and had such a positive influence on the lives of the students that years later his impact is still felt. Bill is actively involved with local business and community organizations. He serves on or is directly involved with over 35 boards. These include: the Orange County Business Council, United Way of Orange County, Discovery Science Center, the Ocean Institute, Drug Abuse is Life Abuse, Pretend City, Junior Achievement and many more. These contacts and experience have given him a wealth of stories and real life experiences that bring his public speaking to a new and exciting level.

Bill is a fantastic communicator with people of all ages and backgrounds. He engages his audience with a dynamic presentation made up of video clips, beautiful slides and sometimes infused with magic that keeps everyone on the edge of their seats. Bill has been writing monthly articles for a number of educational publications and has his own television show “Spotlight on Education” which focuses on current events and issues in education. Bill recently had the distinction of filling in as the closing keynote speaker when former President Bill Clinton was unable to do so at the national conference of the Association of Educational Service Agencies (AESA).

Additionally, Bill is an inventor and has been honored with several prestigious awards:

Habermehl was appointed to the post of County Superintendent of Public Instruction prior to the 2002 election taking over for John F. Dean. The policies in place back then are the same as the policies in place now, which lead to the ability of the County Board of Education to appoint a replacement instead of letting the voters decide.

BREAKING NEWS: Orange County Superintendent Bill Habermehl Retiring

We here at OC Political have just become aware of Orange County Department of Education Superintendent Bill Habermehl announcing his retirement. The word on the street is that a replacement could be chosen by as early as the beginning of June.

We will follow-up with more information as it becomes available. Stay tuned for a post later with more information as well as a look back at the career of Habermehl.

Dr. Ken Williams Opposes Munger/PTA Tax Hike

Dr. Ken Williams Opposes Munger/PTA Tax Hike

Orange County, CA (April 30, 2012) – Orange County Board of Education Member Dr. Ken Williams has announced his opposition to the Molly Munger/PTA initiative that would impose $10,000,000,000 in taxes on Californians.

The initiative, which has qualified for the November ballot, would not only increase income taxes on all California couples making $17,500 a year or more but would also increase the collection of private parental and student information from all families in California.

“Collecting private family information and raising taxes on Californians is not the solution. It is wrong to overspend the people’s money on wasteful bureaucracy and collect private and personal information on families,” Williams said. “It is time for Sacramento Democrats, politicians, and Governor Brown to limit the scope and size of government and start making fiscally responsible decisions and finding ways to balance the budget without raising taxes.”

As a member of the Orange County Board of Education, Williams has led the Orange County Department of Education as the proven fiscal conservative on the board. His voting record as a governing county board member reflects his pledge of “No New Taxes” and the financially strong fiscal viability of the county department of education.

Williams serves his constituents as their consistent conservative voice on the board, promoting traditional family values, public safety and safe schools, high academic standards, educational accountability, parental rights, and a “back to basics” approach to education.

During his first campaign for office in 1996, Williams defeated a twenty-year incumbent by running on a “back-to-basics education” theme that resonated with the voters of Trustee Area 3. A home-grown community leader, he is an Orange County native who graduated from the county’s public schools. He is a family physician in private medical practice since 1986 and is on the medical staff at St. Joseph Hospital, Hoag Hospital, and family practice department chairman at Children’s Hospital of Orange County.

Trustee Area 3 consists of the cities of Brea, Irvine, Orange, Villa Park, and Yorba Linda; the communities of Anaheim Hills and North Tustin; and portions of East Anaheim, Lake Forest, Tustin, and Orange County’s canyon communities.

Republican Candidates Out Walking Tomorrow!

In a huge sign of campaign momentum Todd Spitzer candidate for 3rd District Supervisor and Robert Hammond candidate for County Board of Education are participating in what is set to be a big precinct walk in Tustin tomorrow. (Full disclosure: Custom Campaigns is the consultant running the Hammond race and Todd Spitzer is an advertiser on this blog).

Volunteers will meet at 9:00 AM at the Starbucks located at 552 East First Street in Tustin, CA 92780. This is in the Vons shopping center near the corner of 1st and Newport.

It is always a major sign of momentum to get a large group of people out walking to support candidates running for offices, especially non-partisan ones. With tomorrow scheduled to be  beautiful day according to weather reports this should be a great event.
