Fiscal Cliff: You may be wondering why you did not hear from me during the last few weeks of the “fiscal cliff” machinations in Washington. For one thing, I figured that many of you were enjoying the holidays with your families and friends and did not want me to interrupt that with depressing news. Additionally, however, things were moving so fast that anything I wrote you would have been obsolete by the time you read it. OC’s New Republican Congressmen Vote 3-1 Against Fiscal Cliff Deal; Old Ones Voted 3-2 in Favor

In a far-too-brief summary of the fiscal cliff deal: income taxes increased on people making more than $400,000 (couples over $450,000), tax deductions phase out for individuals making more than $250,000 (couples over $300,000), payroll taxes increased on people making more than $50,000, the death tax was increased from 35% for estates over $5.12 million to 40% for estates over $5 million, the Earned Income Tax Credit was expanded, college tuition tax credits were extended for five years, and federal unemployment benefits were extended for a year.

The vote on the fiscal cliff provides an interesting illustration of the impact of redistricting on Orange County’s Congressional representation.

How the Representatives of the New Congressional Districts Voted on the Fiscal Cliff Deal

The old OC delegation voted 5-2 in favor of the fiscal cliff deal while the new OC delegation voted 4-3 against the fiscal cliff deal, with the new 8th member not yet seated.

More interestingly, the old districts had Republicans 3-2 in favor of the deal with the Democrats at 1-0 while the new districts have Republicans 3-1 against the deal with the Democrats at 2-0.

Ed Royce (R-Fullerton), Linda Sanchez (D-Cerritos), and Loretta Sanchez (D-Santa Ana) voted in favor of the fiscal cliff deal.

John Campbell (R-Irvine), Darrell Issa (R-Vista), and Dana Rohrabacher (R-Huntington Beach) voted against the fiscal cliff deal.

(Newly Elected Congressman Alan Lowenthal (D-Long Beach) will not take take office until later this morning.)

Congressmen Gary Miller (R-Diamond Bar) and Ken Calvert (R-Corona) represented portions of Orange County until yesterday but now represent exclusively Inland Empire districts.  Miller and Calvert both voted for the fiscal cliff deal.

2012 General Election Prediction: 45th Congressional District

This race in the primary pitted Tea Party darling John Webb, sitting U.S. Congressman John Campbell, and Irvine Mayor Sukhee Kang for the right to advance to November. The results were extremely one-sided with John Campbell

United States Representative; District 45

  • John Campbell, Republican ………. 54,346 votes 51.0%
  • Sukhee Kang, Democratic ………. 35,182 votes 33.0%
  • John Webb, Republican ………. 17,014 votes 16.0%

As you can see from the results posted to the “Smart Voter” website despite having a Republican opponent Congressman Campbell still managed to break 50% in the primary.

I will give Sukhee Kang credit for running 5% above Democratic registration. However, with 22% of voters registered as DTS Kang did not have a great showing in the whole scheme of things. Also remember that Democrats tried the Irvine Councilmember strategy back in 2010 running Beth Krom against John Campbell. Krom did not have a great showing either:

United States Representative; District 48

  • John Campbell, Republican ………. 145,481 votes 60.0%
  • Beth Krom, Democratic ………. 88,465 votes 36.4%
  • Mike Binkley, Libertarian ………. 8,773 votes 3.6%

Kang is from Irvine, the largest city in the 45th Congressional District but unfortunately for him John Campbell also is from Irvine.

With a 20% Asian population in CD 45 you could make the argument that Kang will be one of the more competitive candidates in years. I would argue that party affiliation is more important when running for partisan office.

The fundraising tells a similar story with John Campbell at over $1,000,000 cash on hand after the primary election and Sukhee Kang having under $250,000 cash on hand. This is over a 4:1 ratio for the sitting Congressman.

Looking at all the factors at play in this district I believe that the winner will be:

Episode VII – Education: In 1979, President Jimmy Carter created the Federal Department of Education. He did it to make the quality of education in this country better. This year, that department will have an administrative budget of $69 billion. That does not include the roughly $19 billion in federal dollars we will spend on education entitlements like Pell Grants and student loans.

The question is simple: Is American education better now than it was in 1979? Has spending trillions of federal dollars over the last 33 years led to America’s students consistently receiving a superior level of education?
The answer is painfully obvious. NO! So, why are we still trying to do what has failed for over 30 years expecting to achieve positive results?!

Sorry. I’ll calm down now. I have included education in this “Fix It” series on how to jump start two new decades of American hegemony, growth and prosperity because, like infrastructure, a strong education system is a prerequisite to growth and prosperity. So then, what is the state of education in America? In order to analyze our system, we have to break education into two distinct categories which are in very different places right now: K-12 education and higher education.

We already have the finest higher education system in the world, bar none. This is so for a number of reasons. Amongst them is that we have many private, public and for-profit colleges competing with one another in the marketplace. There is relatively little government interference in this category, which is a significant part of its success. Unfortunately, President Obama recently indicated that he would like the government to regulate what a unit of higher education is and how much it can cost. This is the President’s road map to screw up a part of America that is actually working. Unbelievable!

Higher education is too expensive. But, that is not because the government has not interfered enough. It is because it has interfered too much. Over the last 30 years, the inflation rate on higher education tuition has been greater than any other part of the economy. Health care is second. The increases in both dwarf the inflation rate for energy or housing or food. And, do you notice something in common with higher ed and health care? Both have a lot of government subsidies. The increases in college tuition have largely corresponded with the increases in federal assistance. When I was an undergrad at UCLA in the mid-1970s, my tuition (I remember well) was $625.50 per year. Today, in-state tuition at UCLA is $12,686 per year. That means it has increased more than 20 times over that time period. Gas and housing have also gone up over that period, but not by 2000%. And, that is in spite of increases in California tax rates since then.  Now, all this being said, the state of higher education could be much worse. But, if we are concerned about the cost, we should be looking at whether federal subsidies have caused higher tuitions, rather than helped reduced them.

Unfortunately, our K-12 system is in a different place. We do NOT have the finest primary and secondary education system in the world. And, we do NOT have many private, public and for-profit K-12 schools competing in the marketplace. There are roughly 98,700 public schools in the United States. There are about 33,700 private ones. The details of fixing K-12 education are way beyond the scope of this series. But, there’s one thing I know: We can’t fix 98,700 schools from Washington, DC. We can’t even fix California schools from Sacramento. Parents, teachers and administrators closer to the problem should have more freedom and flexibility to respond to their own unique needs.

So, get rid of the Department of Education. Save half the money the department currently costs and give the other half directly to the states and local school districts. However, most importantly, give them the flexibility to create competition and fix their problems. They will do it.

Why I Did Not Vote to Endorse John Campbell for Re-Election

In February of this year the Orange County Republican Party (“OCGOP”) voted to endorse several incumbent Congressmen for re-election. One of the incumbents seeking that endorsement was Congressman John Campbell. As an elected member of the OCGOP I was entitled to a vote and to voice my opinion on the subject. I spoke out against that endorsement and voted No.

This was the first time the OCGOP was doing endorsements for partisan offices since the passage of the terrible “Top Two Primary” of Proposition 14. Prior to passage of Prop. 14, the official party did not endorse in partisan races such as Congress. But Prop. 14 has forced the Republican Party to do so and the OCGOP is the official arm of the Party in Orange County.

The tipping point for me regarding Congressman Campbell was the December 2010 lame duck Congress’ vote to repeal the military’s policy of “Don’t Ask, Don’t Tell” (“DADT”) regarding active homosexuals serving in the military. Prior to this vote I was becoming troubled with Congressman Campbell’s vote in favor of TARP and Cash for Clunkers and his abstaining on the vote to bailout the auto industry. When Congressman Campbell 1st ran for Congress in a special election, I was one of those who supported him by helping him obtain the endorsement of the California Republican Assembly and walking precincts for him. Until the most recent re-districting, I lived inside Mr. Campbell’s congressional district. Seeing him vote with the lame duck Democrats for the repeal of DADT was a shock and disappointment.

As a former U.S. Marine (1975 – 1978), I understand something about serving in the military including what I consider very severe challenges to service members’ 1st amendment rights of freedom of religion and free speech due to this change in policy. Almost immediately I wrote a letter to Congressman Campbell advising him that I did not agree with his vote, that as a former member of the military I felt I had some legitimate concerns over the implications of the repeal of DADT for those serving our country in the armed forces and I asked to meet with him to discuss this.

For over one year Congressman Campbell knew of my request (according to his District Director) but never would meet with me. At the OCGOP meeting in February I asked him to explain his vote to repeal DADT and why he would not meet with me, one of his supporters and constituents. Congressman Campbell stated to the members and guests of the OCGOP that he felt his vote was right partially due to information he, as a Congressman, had that we constituents did not have (can we spell arrogance!). He then went on to state several other things he has done as a Congressman that he was proud of – without once explaining why he would not meet with me (in his oral response to my questions he did not even acknowledge me or my letter to him on the DADT subject).

Almost immediately following this, Bill Dunlap (an OCGOP alternate) rose and asked Congressman Campbell why he is never in the District to meet with constituents or hold town hall meetings (bravo Bill!). The Congressman’s only response was that he feels his mass e-mails to his e-mail list is sufficient. I guess that means to the Congressman that face-to-face contact with voters in his District is not only not important but also not needed.

I am not important in this matter. What is important is a person who is supposed to be a representative in Congress who refuses to meet with a constituent on an important public policy issue. In my opinion that is not a proper attitude for a Congressman. Congressman Campbell did not lose my vote for endorsement – he did not earn it.  Congressman Campbell fell short of the two thirds votes necessary for him to receive the OCGOP endorsement (He was later able to obtain the endorsement of the CRP when the executive board met privately).

For those who live in the new 45th Congressional District, as you consider who to vote for in the June 5, 2012 election, I offer you this information for your consideration. If I lived in the 45th District I would cast my vote for Republican John Webb.
