Politics and Policing in Yorba Linda; Election 2012

I saved the seven pieces of mail I have received so far related to the Yorba Linda City Council race. Here are the two that I found most disturbing.

These pieces are sent by the “Association of Orange County Sheriff’s Independent Expenditure”.

These pieces make the same claim that the contract with OC Sheriff will save the city $10 million dollars. This is over the course of the five year contracted term and based upon the proposal which was approved several months ago. The claims go on to state that the new contract, at the lower rate will give Yorba Linda a “full service police station” for the first time, give Yorba Linda a Chief of Police, provide greater protection and hire displaced Brea Police officers. The veracity of all of these claims have been widely debated in my earlier blogs here and in several other (mostly sponsored) forums. The soundness of the bid, the assertions of nearly magical outcomes and historic savings are not the issue in this election.

Citizens of Yorba Linda, if you were not certain before, now that you have received your ballots and sample ballots, this issue is not, has not, will not, be put to you the voters for a vote. Your council, Schwing, Rikel and Anderson, voting en masse as they do (Your other two representatives are also not part of this discussion as they are irrelevant) have already decided this issue for you, and the train has left the station. The transition is set to occur by May 2013.

As this situation developed and unfolded, in the Spring of 2012, it was covered on a regular basis, here on OC Political.

With that resounding victory behind them, our council could turn their attention to more pressing matters, their re-election.

You may recall, that in 2010, a MEASURE Y appeared on your ballot. It involved ethics of City officials and essentially prohibited any candidate from accepting any donation from ANY contractor with the city. This was targeted at that time at specific organizations, such as the Chamber of Commerce, that had in the past, ventured so far as to endorse business friendly candidates. It was a witch hunt environment that surrounded the 2010 City Council election and the Measure (which was identical to a City Ordinance that had already passed and been made law) and certainly chilled the free speech of many in our city and discouraged involvement in the process.

The supporters, again Schwing, Rikel, Anderson, of Measure Y, promoted it as a measure that was consistent with the overall approach of the Republican party, locally and statewide to reel in candidates whose campaigns may be funded by Government Employee Unions.

Of the Majority Three, only Anderson was up for re-election in 2010.

In 2012, both Schwing and Rikel are facing re-election.

Following their granting of the $10 million dollar policing contract to the Orange County Sheriff Department, it was nice of the Union to repay them with the two very large (8×10 glossy, 2 sided) mail pieces that went to voters in Yorba Linda.

“The fiscal conservative team we can trust”…..Yep. So long as your definition of ‘fiscal conservative’ means union hack. “Leaving no stone unturned to root out government waste”, when you define government waste as 40 years of institutional knowledge. Well they’ve certainly rooted out something, and I can only wonder if and when Yorba Linda voters are going to stand up to the charade.

These incumbents, in their other mailers, boast prolifically about their “endorsements”. I can not speak to the process by with Assemblyman Hagman and Congressman Royce made their decision to endorse these incumbents, but I was present for the Orange County Republican Party Endorsement approval.

On such races, there is no discussion in and among the Central Committee of the Orange County Republican Party. These candidates were the only ones who turned in their requests for endorsements on time, and this is not unusual in small city races. Inexperienced candidates, often with no political professionals to advise them, do not realize the early filing date, and the rapid fire manner in which the endorsements are granted. There were only the two applications for this race. They are Republican. They are incumbents. There was not discussion, no vetting.

However, because the Orange County Republican party is very concerned about fiscal issues, making sure we help true fiscal conservatives to get elected, and not usher in more special interest lackeys, there is an application. Four pages of fairly extensive, Republican ideal quizzing. On Page One, the applying candidate must sign the following “Union-Free” pledge:

“I WILL NOT ACCEPT CAMPAIGN CONTRIBUTIONS FROM GOVERNMENT UNIONS”

I’m not sure how Mr. Schwing and Ms. Rikel want to explain this, because their application would not have ben processed by the Central Committee without it all complete. Perhaps they will say the mailers were a “spontaneous protest” and not a “pre-planned strategic strike”. Are the pledge and the policies to mean anything? Not to mention the outright violation of their own law. I fully anticipate their argument about semantics will be that these mailers were not ‘contributions’ processed by their campaigns. We will soon know what the voters have to say about it all.

New Poll Shows Allen Leading Edgar

Got an e-mail from Probolsky research yesterday that showed Travis Allen leading Troy Edgar by a slim margin in the hotly contested 72nd Assembly District race. It is important to note that a vast majority ov voters are undecided but this is clearly promising news for Travis Allen.

Here are the poll results:

On Saturday, October 13, 2012 Probolsky Research conducted a telephone survey of likely voters in California Assembly District 72.

TRAVIS ALLEN LEADS TROY EDGAR

Allen enjoys a lead over Edgar (28.0% to 22.1%) in the race for the 72

nd Assembly District. However, nearly half of voters remain undecided:

“An election for California State Assembly District 72 will be held in November. If you were voting today for State Assembly, for whom would you vote? Pick one. If you have already voted, please let me know who you chose. Travis Allen, Prefers Republican Party, Small Business Owner OR Troy Edgar, Prefers Republican Party, Businessman/Mayor.”

A total of 307 surveys were collected. A survey of this size yields a margin of error of +/- 5.7% with a 95% degree of confidence. Interviews were conducted with voters on both landline and cell phones and were conducted in English, Spanish and Vietnamese languages.

The turnout model consisted of those voters who voted at least 1 of 11/10 or 6/12, OR voted in at least 2 of 2/08, 6/08, 11/08, 5/09 or 6/10, with at least 1 being 11-08 PLUS those who registered to vote after 6/12.

This represents 62.2% of voters and 72.3% of households.

Edgar Strategy to Reach Out to Democrats: Recycling?

Conventional wisdom suggests that the winner in AD72 will be the candidate who is best able to reach out to Democrat voters. Troy Edgar’s campaign has apparently really taken this to heart, as they seem to be rebuilding their campaign around a theme of RECYCLING.

And no, I don’t mean that in an effort to appeal to voters in Huntington Beach or Seal Beach that Edgar has organized Beach Cleanup Days or anything like that.

No. Instead, Edgar’s campaign has taken to recycling their Press Releases.

Now obviously saying this is an effort to attract Democrat voters is in jest, but just how stalled is the Edgar campaign that they’re already having to take to using old Press Releases – this past week they sent out a release announcing endorsements from local Mayors, the same release they first sent out on 4/18/12 — to insinuate continued momentum?

Compare that with Allen’s campaign.

  • Van Tran comes on board with the Allen campaign as a Senior Advisor.
  • Troy Edgar lies to the press about lying to the Federal Elections Commission.
  • Allen’s campaign announces the endorsements of Joe Dovinh and Long Pham.

It is clear which campaign has momentum, and which candidate isn’t just stuck in neutral – but seems to be cruising in reverse.

AD-69: Moreno Drops Out Citing Hatch Act, Name Will Remain on Ballot

In case you hadn’t read the other blogs (like Liberal OC or Orange Juice) yesterday, Republican 69th Assembly District candidate Jose “Joe” Moreno announced that he was dropping out of the AD-69 race because of the Hatch Act.

While the timing is surprising, this development itself should not be of surprise to anyone:

  • On March 29, Moreno wrote to the Registrar of Voters attempting to withdraw from the AD-69 race, citing the Hatch Act.  (The Registrar denied this request.)
  • In the second week of April, OC Political, the OC Register, the Liberal OC, and then OC Political again speculated/warned/advised that Moreno’s candidacy likely violated the Hatch Act.
  • On April 21, Moreno issued this press release declaring his candidacy was not in violation of the Hatch Act.
  • On April 23, the Liberal OC again wrote that Moreno’s candidacy violated the Hatch Act.
  • On July 18, unbeknownst to the OC mainstream media and blogosphere, the U.S. Office of Special Counsel issued an advisory opinion, entitled “California’s Voter-Nominated Primary Elections are Presumptively Partisan for Purposes of the Hatch Act.”

In that July 18 advisory opinion, the U.S. Office of Special Counsel  stated:

In short, California’s voter-nominated elections are presumptively partisan elections for purposes of the Hatch Act. As such, an SSA employee covered by the Hatch Act may not be a candidate in voter-nominated primary elections.

The advisory opinion also states:

…even if voter-nominated elections were designated nonpartisan by the California Constitution, and therefore presumed nonpartisan for purposes of section 1503, the presumption would be rebutted. The California Constitution allows candidates in the voter-nominated primaries to list a party preference following their names on the ballot…

Though the advisory opinion is redacted, it’s fairly obvious that this was the advisory opinion requested regarding Moreno.  There are only 306 candidates running in a California voter-nominated race in November (2 each for the U.S. Senate, for 53 U.S. House races, for 20 State Senate races, and for 78 Assembly races, plus Assemblywoman Susan Bonilla (D-14) and Assemblyman Isadore Hall III (D-64), both of whom are unopposed).  Moreno is the only one of the 306 to work for a Social Services Agency.

(One interesting footnote in the advisory opinion:

Arguably, if in a particular voter-nominated primary election all of the candidates were to run without designating a political party as their party preference then the election could be considered a nonpartisan election for purposes of section 1503 of the Hatch Act.

So a bunch of NPPs running could technically make the race nonpartisan for purposes of the Hatch Act.)

In April, OC Political had noted the case of Geof Lickey, who was able to get off of the June 2012 ballot for the AD-31 seat due to the Hatch Act because he acted more quickly than Moreno did.

The fifth commenter on this June post from Liberal OC pointed to the case of Judge Ronald Kline, who withdrew in the tiny window after the primary but before certification of the election.  The courts eventually ruled that third-place finisher Gay Sandoval would replace Kline on the November runoff ballot.  (John Adams, who had originally won the right to face off against Kline, defeated Sandoval.)

Had Moreno or the Orange County Social Services Agency moved more quickly to seek an advisory opinion from the U.S. Office of Special Counsel back in April, Moreno’s ineligibility could have been discovered sooner, and he could have withdrawn during the primary.  Considering Moreno only edged out Julio Perez by 242 votes, it is not inconceivable that more than 242 voters had Googled the race and discovered that Moreno’s press release or the various blog posts (such as this one from Orange Juice) in which he declared as lies the Jobs PAC IEs on behalf of Daly that claimed Moreno had dropped out (I believe his claim was also posted on his web site before he took it down).

Or if Moreno had withdrawn before the June primary was certified, voters in AD-69 would have had a choice between first-place finisher Tom Daly and third-place finisher Julio Perez.  Due to Prop 14, voters don’t even have the choice of a write-in candidate, so this late withdrawal leaves AD-69 voters with the choice of Daly or the withdrawn Moreno.

While this was Moreno’s first run for partisan office, this was not his first time throwing his hat in the political ring.  According to JoinCalifornia, Moreno had previously run unsuccessfully for Orange County Board of Education (2000 primary), Rancho Santiago Community College District (2000 general), and Anaheim Union High School District (2010 general).

We are now left with just two questions: Will Moreno resign his ex officio seat on the Republican Central Committee?  What will Garden Grove Councilman Steve Jones do about his endorsement flip-flopping between Democrat Daly and Republican Moreno.

OC Weekly Exposes Troy Edgar’s Campaign Finance Crimes

OC Weekly’s Scott Moxley has once again exposed potential crimes by an OC Politician.  For those you who are not aware of Moxley’s previous work, he is the same reporters that exposed disgraced Former Sheriff Mike Corona.  Moxley was also the reporter that brought the Mike Duvall sex scandal to light.

It looks like once again, Moxley has manged to get the scoop and expose yet another politician’s dirty laundry.

Troy Edgar’s Missing Mailer Money

In January, for his now-defunct congressional campaign, Edgar produced and delivered an eight-page glossy mailer to 3,000 Southern California Republican power brokers. The objective was to win endorsements, raise contributions and frighten potential GOP opponents away from the race. As political literature goes, the piece wasn’t bad. It hailed his leadership skills, conservative policy stances and family values. To bolster credibility, District Attorney Tony Rackauckas declared on the front page of the brochure, “Supporting Troy Edgar for Congress was an easy decision.”

It might be a line the DA, who recently announced he’s seeking additional resources to prosecute corrupt public officials, will soon wish he hadn’t uttered because the brochure could be the centerpiece of two crimes. Let me explain.

Because of anti-public corruption concerns resulting from the Watergate scandal in the 1970s, federal campaign-finance laws require campaigns to publicly disclose major expenses. The rationale is that voters should know if a candidate is up to no good. According to records obtained by the Weekly, the power-broker brochure cost more than $5,668, but Edgar never complied with federal election rules to disclose the spending or reveal who paid for it.

Indeed, he disclosed 41 separate congressional-campaign disbursements but not this one—which also happened to be the committee’s largest expenditure.

Asked to explain, the candidate first said he is unfamiliar with that specific mailer because he has sent out “hundreds” of them. Later, he assured me the power-broker disbursement “absolutely shows up” on a disclosure report. When I told him it didn’t and asked him to resolve what happened, he replied he “printed it at home,” which is troubling because, as I write this column, I’m looking at a detailed invoice for the job from Sparta Graphics.

2012 General Election Predictions: 74th Assembly District

This race will be a lot more mild after the fight that we saw in June between Allan Mansoor and Leslie Daigle. Now we have a partisan fight between Allan Mansoor (R) and Robert Rush (D). The 74th Assembly District is a conservative South County seat:

As you can see Republicans have a registration of 42.7%, Democrats 29.3%, and DTS 23.2% (remember DTS voters will lean conservative in this district). With that being said we almost $300,000 pumped into this race in expenditures on behalf of Leslie Daigle. These expenditures helped her jump all the way to last place.

The results from June can be viewed here:

Member of the State Assembly; District 74

  • Allan R. Mansoor, Republican ………. 33,319 votes 43.5%
  • Robert Rush, Democratic ………. 25,120 votes 32.8%
  • Leslie Daigle, Republican ………. 18,207 votes 23.8%

Mansoor fell under 50%, however, the reason for this is likely the hit pieces that the Daigle campaign did against him. My gut feeling is that the majority of people who voted for Daigle will vote for Mansoor in November. The reason for this assertion is because partisan Republicans were split between Daigle and Mansoor. These Republicans will only have one candidate to vote for from their party in November.

Financially Robert Rush is in the same ballpark as Mansoor. Rush may have over $55,000 after the primary and Mansoor has just over $50,000/ Rush is going to need a lot more money to make up the deficit he is already facing after June.

Looking at all the factors at play in this district I believe that the winner will be:

Breaking: Former OC Assemblyman Richard H. Robinson Arrested for DUI in Sacramento on Fox 40

Fox40 in Sacramento reported a man was arrested in a car with the license plates of a retired State Assemblyman.  Though they have video footage of him, Fox40 has been unable to identify him.

Sacramento sources inform OC Political that former Orange County Assemblyman Richard H. Robinson (D-Garden Grove) was the arrested retired legislator in question.

A Democrat, Robinson served in the Assembly from 1974-1986, when he made an unsuccessful bid to unseat Congressman Bob Dornan.

(Update 10:35 PM): Here’s the link to his arrest record from Sacramento Sheriff. (8:02 AM: Sac Sheriff took the link down, but here’s a screenshot of the arrest log.)

According to Join California, Robinson is a former Director of Operation Drug Prevention of Orange County and was Assembly Democratic Caucus Chair from 1982-1984.

(Updated 11:21 PM): Sacramento viewers inform OC Political that Fox40 ended their 10 PM newscast saying “people on the Internet” had ID’d the driver, but Fox40 refused to name Robinson despite the link to the arrest record.

A self-proclaimed conservative political blog based out of southern California is suggesting that this is the same Richard Robinson that served in the State Assembly from 1974 to 1986 as a Democrat representing Garden Grove.

2012 General Election Predictions: 73rd Assembly District

It appears that I was wrong about Don Wagner still having the most conservative district in California as it appears that the new AD 73 is a bit more conservative:

Republicans won every race in 2010 within the boundaries of this district and registration shows that 48.9% of voters are Republican and only 25.6% of voters are Democrats. The conservative leaning DTS voters make up around 21.2% of the electorate.

An even bigger factor is that Harkey had the largest margin of victory in Orange County:

  • Diane L. Harkey, Republican ………. 49,922 votes 70.2%
  • James Corbett, Democratic ………. 21,173 votes 29.8%

This result makes it clear that Corbett has no chance in November. It also doesn’t help that he has not raised enough money to trigger online filing. Harkey on the other hand has over $164,000.

Looking at all the factors at play in this district I believe that the winner will be:

2012 General Election Predictions: 72nd Assembly District

THis race is the one I am predicting will be the closest and most heated in Orange County. Surprisingly 2 Republicans advanced from the June election to make this race as interesting as it is. The district is somewhat comparable to a more coastal version of Allan Mansoor’s old assembly district when it was AD 68:

Party affiliation is meaningless in this race because they are both Republicans but it will be interesting to see which candidate targets the 31.6% of registered Democrats first. It is also interesting to note that Huntington Beach is the largest part of the district which is where Allen is from. Los Alamitos is the smallest city on the district which is where Edgar is from.

The results in June are inconclusive because it was close enough to where anybody could end up a winner in November. Here are the June results:

Member of the State Assembly; District 72

  • Troy Edgar, Republican ………. 18,060 votes 28.0%
  • Travis Allen, Republican ………. 12,851 votes 19.9%
  • Joe Dovinh, Democratic ………. 12,432 votes 19.3%
  • Long Pham, Republican ………. 12,409 votes 19.2%
  • Albert Ayala, Democratic ………. 8,816 votes 13.7%

It is pretty amazing to see who close Allen, Dovinh, and Pham were to that 2nd place slot. Looking it the results it appears that Edgar has an advantage going into november which would mean that Travis Allen needs to raise his favorability amongst voters before voting in November.

Fundraising is the kicker for me, as Edgar has just under $100,000 in his account after the primary and Allen has just over $10,000 in his account. This can change with campaigning which will mean that this race will be extremely close. My prediction is based on the campaign as of right now and I reserve the right to change my opinion on this one:
