Candidate Claims Federal Facility as Residence on Voter Registration

In an unusual incident, there is a candidate for the Orange County Board of Education, Trustee Area 5, who is claiming a federal building as a residence on her voter registration form.

The Registrar of Voters does not publish candidate addresses online. However, it does have candidate addresses available for public viewing and copying at its front counter, since candidates’ addresses are subject to public disclosure.

At OC Political, we generally do not publish home addresses. However, since this particular “home” address is a government building, we’re publishing it here, since it’s not really a home. According to the Registrar’s candidate filing log, Kimberly Clark is registered to vote with a residence address of 24551 Del Prado in Dana Point:

(If you go to 24551 Del Prado, final collection is at 5:00 PM six days a week, though its retail hours are 8:30 AM-5:30 PM on weekdays and 9:00 AM-3:00 PM on Saturday. You can get your passport photo taken or submit your passport application from 9:00 AM-2:00 PM on weekdays and 9:00 AM-12:30 PM on Saturday. The lobby is open 24/7. I was surprised to learn you could obtain burial flags at this Post Office, as my local Post Office offers no such service. That’s right, Kimberly Clark is claiming a United States Post Office as her residence. Yes, I’m aware that it’s permissible to claim a post office as a mailing address, but she has PO Box 938 as her mailing address. She clearly has 24551 Del Prado as her residence address in the filing log.

I’ve heard of accusations of candidates registering to vote at addresses where they do not live, but this one has to take the cake. Usually, candidates will at least claim a residential building, but to claim a Post Office?! That’s ridiculous.

In a time when there are State Senators who have been convicted of eight felony counts for perjury and voter fraud by claiming a false residence on their voter registration forms (if you don’t know what I’m talking about, Google “Rod Wright” or Google “Roderick Wright”), you would think a candidate would be a little more discreet than claiming the Post Office as a residence.

After the District Attorney obtained search warrants for both Wright’s claimed residence in Inglewood and the residence in Baldwin Hills investigators say was his actual home, a grand jury indicted Wright in 2010. Just this January, Wright was convicted of perjury for lying about his address on voter registration forms and candidacy forms and for voting in five elections in 2008-2009 at his fraudulent address (remember, there three statewide elections in 2008 and a statewide special election in 2009; this is in addition to local 2009 elections in LA County).  Wright’s sentencing is scheduled for March 12, and he could face up to eight years in prison.  Wright’s defense hinged on the legal definition of a domicile, as opposed to the definition of a residence, but the jury didn’t buy it.  It would be more challenging to argue that a Post Office is either a domicile or a residence, as Wright claimed a residential building, rather than a Post Office.

A similar case is pending against former LA City Councilman Richard Alarcon (himself a former state senator) for perjury and voter fraud.  There is some legal wrangling over the Alarcon case, but this one is over whether prosecutors considered adequate evidence proving that Alarcon resided at his claimed address.  Again, it’d be tough to have evidence proving you reside at a Post Office.

Clark has pulled papers for OC Board of Education Trustee Area 5 to run against incumbent Elizabeth Dorn Parker and Laguna Niguel Mayor Linda Lindholm.  Parker’s Costa Mesa residency and Lindholm’s Laguna Niguel residency are both well-established and unquestioned.

Mayor Linda Lindholm Enters County Board of Education Race, Endorsed by Current and Past Trustees

ORANGE COUNTY, CA – Laguna Niguel Mayor Linda Lindholm announced today that she is running for the Orange County Board of Education’s Trustee Area 5 seat.  Mayor Lindholm enters the race with $50,000 cash-on-hand and the endorsements of a number of school board members, including Orange County Board of Education Trustee Robert Hammond and former Orange County Board of Education Trustee Eric Woolery.

“Every child deserves the opportunity to succeed to the best of their abilities, and parents must have the ability to obtain the kind of education that suits their child’s unique needs,” Lindholm said. “We must ensure that education taxpayer dollars are spent directly in the classroom, not on administrative bureaucracy.”

Mayor Lindholm has served as the President of the Saddleback College Foundation Board, as President of the Beta Foster Care Advisory Board, and as the City Liaison on the Laguna Niguel Youth Committee.  She has also served on the Capistrano Unified School District Instructional Materials Review Committee and the Prevent Child Abuse – Orange County Advisory Board.  Professionally, she has taught college students as a university instructor and worked with school districts on developing programs for teachers of children with physical and learning disabilities.

“With her background as an educator, her service in education, and her work as an elected official, Linda Lindholm brings a wealth of experience that will prove to be of great value to the County Board of Education,” said Trustee Robert Hammond. “Linda Lindholm is exactly who Orange County residents need on the Orange County Board of Education.”

Mayor Lindholm is a recipient of the Saddleback Community College Community Leadership Award and the Beta Foster Care Community Service Leader Award.  She was also previously named Woman of the Year for the 73rd Assembly District and Mother of the Year by American Mothers for Civics and Community.

A businesswoman, Mayor Lindholm earned her Bachelor of Science Degree from Colorado State University and has a Master’s Degree in Public Administration from the University of Kansas.  Lindholm and her husband, Wayne, have three children.

I meant to open with this post today. In 2012 a number of candidates went unopposed and a number of candidates spent under $1,000 (they don’t have to file a detailed campaign report). I will weed out races that are in this category and outline them in an upcoming post.

County Board of Education to Discuss Controversial Common Core Curriculum, AB 1266

OCBESealThe Orange County Board of Education has agendized a discussion of the controversial Common Core curriculum for its meeting this morning.  Under the information items proposed by Board members, the Board has the following on its agenda:

Williams’ OC Register Editorial – Boyd
Oath of Office – Boyd/Parker
AB1266 Resolution – Hammond

(Boyd is Board President David Boyd, who represents the 2nd District.  Hammond is Robert Hammond, who represents the 1st District.  Williams is Ken Williams, who represents the 3rd District.  Parker is Elizabeth Parker, who represents the 5th District.  The only member not mentioned on the list is Jack Bedell, who represents the 4th District.  The district lines roughly follow those of the Supervisorial districts with a few exceptions, including a gerrymander to split the City of Costa Mesa, where both Boyd and Parker reside.  A map of the districts is available here.)

Related to the Common Core discussion, the County Board of Education has also agendized a discussion on this OC Register op-ed on Common Core by conservative Board Member Dr. Ken Williams.  (The Williams op-ed is one of the rare articles that is not behind the OC Register paywall.)  Here are excerpts of the Williams op-ed:

As Obamacare implementation is the subject of national headlines, also in 2014, an equivalent tsunami will occur in America with a controversial national education curriculum arriving in our schools and classrooms. For practical purposes, it transforms and adversely impacts classrooms and removes parents and locally elected school board members from governing schools in their community.

Common Core is a one-size-fits-all program. It was paid for by the federal government – against federal laws that prohibit Washington from establishing national educational standards, testing and curriculum.

It’s similar to the current national health care debate. Common Core’s stealthy implementation by the Obama administration, national and state educational organizations and state governments keep parents and taxpayers in the dark.

Originally, 46 states voluntarily adopted Common Core with federal funding “Race-to-the-Top” grants. Conservative states such as Alaska, Nebraska, Virginia and Texas declined to adopt the standards. As opposition increased across the country, Indiana and Michigan recently dropped out under public or legislative pressure.

Here in California, Common Core was adopted by the State Board of Education in August 2010. A main objection to Common Core is it circumvents the ideals and concept of “local control.” In reality, an unelected, governor appointed, 11-member state board of education, decides without substantive debate. Local boards have little input or ability to change curriculum.

Local control of education has been hijacked specifically by unelected officials holding the purse strings in Sacramento; and in general by the federal government and national education organizations. Common Core dismisses the idealism of local control of education by parents, teachers and school boards laid out in the Northwest Ordinance by our founding fathers; it “dumbs down” academic standards; and huge financial costs are born by taxpayers to implement a national curriculum that is unfunded, and has never been tested or proven.

In today’s paper, the OC Register editorial board noted (sorry, this one is behind the paywall):

[Lance Izumi, director of education studies at the Pacific Research Institute] warned that state schools will shift in 2014 “from the rigorous state standards to less-rigorous Common Core standards. This is a sharp turn backward.” Common Core is a national program, sponsored by the National Governors Association and the Council of Chief State School Officers, to standardize school curricula nationwide. In California, for example, that means pushing the algebra requirement from eighth grade to ninth grade.

The Board will also be discussing AB 1266, which is described by the Privacy for All Students campaign (the effort to overturn AB 1266) as “a bill recently enacted by the California Legislature and signed by Governor Jerry Brown. The legislation creates the right of elementary and secondary school students to use sensitive sex-segregated school facilities such as showers, restrooms and locker rooms based on the student’s perceived gender identity rather than their actual sex. It’s the only legislation of this kind to have ever been enacted in the country.”

The County Board of Education traditionally met on Thursdays, but moved their meetings to Wednesdays, effective with their previous meeting.  They’re scheduled to meet at 8 AM today in their Board room at 200 Kalmus Drive in Costa Mesa.

I was working on a database of the part affiliation of all Orange County local elected officials. Finally, I have completed the project with all of the special districts and county seats being added. I also fixed some errors in the previous versions (here, here, and here) and have combined the database into one post.

Vacancies Galore: Politicians Leaving Mid-Term Leave Seats to Be Filled

Empty chairThere were a lot of vacancies this year.  Three countywide posts and one school board seat remain vacant.  All salaries noted below are base pay.

County

Four of Orange County’s eight countywide posts went vacant during 2012.

  1. Orange County Clerk-Recorder: Tom Daly (D) vacated the seat this month to become the 69th District’s State Assemblyman.  Numerous candidates have either expressed interest behind the scenes or are rumored to be interested; none have made public statements.  The job pays $139,256.40 (that extra 40 cents won’t even get you enough postage to send a letter).  Apply online here by January 15.
  2. Orange County Auditor-Controller: David Sundstrom (R) vacated the seat in January to become Sonoma County Auditor-Controller-Treasurer-Tax Collector (yes, that really is a single office in Sonoma County).  The job pays $173,097.60 per year (that 60 cents is crucial).  Apply online here by January 15.
  3. Orange County Public Administrator: John Williams (R) resigned in January or February depending on how you interpret his resignation, un-resignation, and re-resignation saga.  Former Assemblyman Ken Lopez-Maddox (R), who is also a former Garden Grove Councilman and former Capistrano Unified School District Board Member, is the first to publicly throw his hat in the ring. (12/19 Update:The previous sentence was ambiguously worded, so to clarify, Lopez-Maddox is running for the seat in the regularly scheduled June 2014 election but has not indicated if he will apply for the appointment.)  The job pays $30,000 per year (but the Board of Supervisors frequently consolidates it with the more lucrative appointed post of Public Guardian).  Apply online here by January 15.
  4. Orange County Superintendent of Schools: Bill Habermehl (R) vacated the seat in June, deciding it was time for him to retire.  Seven of the eight countywide posts are filled by the County Board of Supervisors when there’s a vacancy.  This is the eighth post, and the County Board of Education appointed Al Mijares (R) to fill the seat.  The job pays $287,500 per year.

Many people have argued Clerk-Recorder, Auditor-Controller, Public Administrator, and various other County posts should be appointed by the Board of Supervisors instead of elected positions.  Good luck with that.  Just six months ago, 60.5% of Orange County voters rejected making Public Administrator an appointed position.

City Council

They move with great speed to fill Council vacancies in Little Saigon.

  1. Garden Grove City Council: Bruce Broadwater (D) vacated the seat this month to become Mayor of Garden Grove.  Minutes after Broadwater became Mayor, the Council held the vote to fill his newly-vacated Council seat.  New Councilman Chris Phan moved to nominate the November election’s 3rd place finisher, Phat Bui, but he failed to get a second on his nomination. Councilwoman Dina Nguyen (R) moved and Councilman Steve Jones (R) seconded the nomination of defeated Councilman Kris Beard (D), who came in 4th in the election, and the Council voted unanimously to appoint Beard to the seat.  Beard was out of office for mere minutes.  The job pays $8,093 per year.
  2. Westminster City Council: Tri Ta (R) vacated the seat this month to become Mayor of Westminster.  In stunningly rapid fashion, the Westminster City Council left his seat vacant for mere minutes before appointing Margie Rice (R) after Ta replaced Rice as Mayor.  In other words, Ta and Rice simply swapped seats.  The jobs pays $10,206 per year.

The County’s smaller cities took a little more time.

  1. Stanton City Council: Councilman Ed Royce, Sr. (R) vacated his seat for health reasons in February.  Rigoberto Ramirez (R) was appointed to fill the seat in March.  Ramirez is up for election to a four-year term in 2014.  The job pays $10,200 per year.
  2. Villa Park City Council: Councilman Bob Fauteux (R) passed away in February.  Rick Barnett (R) was appointed to fill the seat  in March and won election to a four-year term in November with no opponents.  The job pays nothing.

School Board

For the second time this year, the Anaheim Union High School District Board is filling a vacancy.

  1. Anaheim Union High School District Board (February): Earlier this year in February, Jan Harp Domene (D) passed away unexpectedly at the age of 60.  The board appointed Annemarie Randle-Trejo on a 3-1 vote in April.  OC Political covered this process.
  2. Anaheim Union High School District Board (December): Jordan Brandman (D) vacated the seat this month to become an Anaheim City Councilman.  The board will fill his seat early next year.  The job pays $9,731.52.

Brandman originally won his AUHSD seat in a February 2008 special election after a petition overturned the appointment of Harald Martin (R), who was selected by the Board to fill the seat left vacant due to the unexpected passing of Denise Mansfield-Reinking (R) in May 2007.

The AUHSD board is on its third vacancy in six years.

Special District

  1. Municipal Water District of Orange County, Division 3: Director Ed Royce, Sr. (R) vacated his seat for health reasons in February.  Wayne Osborne (R) was appointed to fill the seat in March and won election to a four-year term in a four-way race in November.  The job pays $26,594 per year.

2012 School Board Party Affiliation Post

As promised, I have now put together a database for the School Board members and their party affiliation based on who will be serving post election. Based on results in a couple of races being close, this list may change before it goes up on the website permanently.

If anybody reading this finds an error (like the situation where I thought Wendy Leece ran unopposed for NMUSD) please let me know so I can fix it.
