Clerk-Recorder Interviews: Larry Bales

9:14 AM– Larry Bales is now in the room.

9:15 AM– He talked about his military background serving during the Vietnam War, working in the office of Orange County Assessor, and working for the FDIC. He is clearly a very intelligent man who has a very strong background in the field of finance.

9:18 AM– He talked about his volunteerism in helping veterans to receive all of their benefits. Also, he mentioned that during his tenure in the office of the Orange County Assessor he ended up helping the Orange County Grand Jury corruption that he discovered while working in the office of OC Assessor.

9:20 AM– He is trying to link the corruption that he uncovered to the passage of Prop 13 linking the scandal he uncovered in the office of the Orange County Assessor (property assessments) to the California outcry on property taxes.

9:22 AM– Supervisor Nguyen asked about his experience and education. Bayles responded that he was involved with the internal review when he worked in Orange County. Supervisor Nguyen also asked if he plans to run for the position in 2 years. Bayles stated that he would run if the office is not consolidated. It has been discussed in the past that the Orange County Supervisors would like to explore the potential consolidation of some offices.

9:23 AM– Supervisor Nelson asked if Bayles plans to seek higher office in the future. Bayles answered that he is not interested in running for any other office and has given it no thought. Supervisor Nelson also asked about the technology aspect of the job. Bayles responded by saying that he has experience needed to improve technology in the office.

9:24 AM– Supervisor Spitzer asked about him running in 1996 against Brad Jacobs (incumbent) for Orange County Assessor and asked about why he ran for the office. Bayles answered that, “The Assessor should have one job to do and he was not doing his job.”

9:26 AM– Supervisor Nelson followed up with a question asking for more details. Bayles simply answered that he has properties that are over assessed. He appears to have really danced around that question without answering it which leads me to believe that something very bad took place in the Assessors office. Supervisor Spitzer followed up with a question asking about his experience managing people. Bayles answered that he has lots of experience through his previous jobs. although the FDIC job was what he focused on.

9:29 AM– Supervisor Moorlach has questions which he plans to ask of all applicants:

1) Are you receiving a public pension?

He answered that he is currently receiving a public pension.

2) What is your highest level of education?

He answered that he has a Bachelor’s degree.

3) Have you been involved in litigation with the County of Orange?

He answered no.

4) Have you ever been subject to any political investigation?

He answered no.

5) Have you run for office before? If so, how many times and for what offices?

He did point out that he has run for office before, “A few times” but could not recall the exact number of times.

6) Do you believe that the office of Orange County Clerk-Recorder needs satellite offices?

He did not give a direct answer but believes that the Fullerton office is not worth the money.

9:33 AM– Supervisor Bates has asked about the financial status of the office of Orange County Clerk-Recorder. Bayles answered that the archives building that was purchased previous to him applying for the vacancy was expensive. Bayles plans to look into the requirements of archives and said he would consider all options to save money.

9:35 AM– Bayles stated, “Service to the people should be the number one priority” for the office of Orange County Clerk-Recorder when asked by Supervisor Nguyen. On a follow-up question he answered that he would look into consolidating certain technologies in order to save money.

9:37 AM– Supervisor Spitzer asked about his position on gay marriage since he might be issuing marriage licenses if appointed to the position. Bayles said that he has no problem with issuing licenses based if the Supreme Court overturns Proposition 8.

9:39 AM– Supervisor Nelson asked about what the first 100 days will be like if he is selected. Bayles answered that a lot of internal reviews will take place and his goals would be to immediately make the office more people/taxpayer oriented.

9:40 AM– In closing he stated that he feels that he is the best applicant based on his experience.

Clerk-Recorder Interviews: Introduction

We are now starting the meeting at 9:06 AM.

9:07 AM- Jack Enda came up to speak on behalf of Hieu Nguyen during the public comment portion of the meeting. He spoke of his experiences working for Gary Granville alongside Hieu.

9:08 AM- Darlene Bloom also stood up to speak on behalf of Hieu Nguyen. She was the Clerk-Recorder briefly during the transition period after Gary Granville passed away and before Tom Daly took over.

9:11 AM- Supervisor Nelson stated that first interview should take place at 9:10 AM. He suggested an opening statement for each applicant, questions and then a closing statement by each applicant.

9:13 AM- They are currently deciding on who will ask certain questions that were prepared by the 4th Supervisorial District staff.

Orange County Clerk Recorder Recap & Preview

Now that we have had some April Fools Day fun on to the real business for the day. Here is a post that has no pranks or jokes in it.

Tomorrow evening we will likely have a new Orange County Clerk-Recorder in place after what I am sure will be a lengthy and intriguing deliberation by the Orange County Board of Supervisors. I will be in attendance live blogging all of the interviews for our readers and giving my take on what is happening. be here with us at OC Political at 9:00 AM to follow along.

To explain how it will be formatted I will start with a post that details the opening of the meeting. After my original post I will have a separate post for every single interview up until the end of the meeting. After the interviews are done I will have a separate post for the deliberation and appointment. With any luck I might even get an interview with the individual who gets nominated. My suggestion to readers in order to be able to follow along live is to click on each post as it goes up and hit refresh to get a live update on what is going on with that interview.

We have had some of the best coverage of the Orange County Clerk-Recorder saga over the past few weeks often being the blog to breaks stories on this subject. Let’s take a moment to recap the process from the beginning.

Supes To Appoint Elected Orange County Publisher Position Today While Scandal Is Discovered

In a move that I did not see coming the Orange County Board of Supervisors have called a special meeting today to fill one of the lesser known County positions up for appointment. The Orange County Publisher is the individual that does all of the publishing for the County of Orange. The typical political insiders that you would expect to see applying for an elected position as the OC Supervisors will be deciding between five different applicants that have had no electoral experience.

Chris Nguyen and I thought about throwing our names into the hat but in the end opted against it, This leaves the Orange County Supervisors with the following names to choose from for the position:

-Steve Mora
-Jim Alford
-Chris Kernan
-Leslie Frazier
-Connor Dunston

These applicants were all coasting through comfortably until it was found out that a scandal existed inside the office of Orange County Publisher. The position was initially created as a full-time elected position which received a $150,000 paycheck per year. In a trick move by the previous elected Orange County Publisher in their contract all nine positions in the office are salaried at $100,000 per year and are paid to the person handling the responsibilities regardless of whether or not they are doing multiple jobs in the office. It appears the previous OC Publisher was doing all 9 jobs along with their elected position to accumulate a salary of over $1,000,000.

On top of the over $1,000,000 salary the Orange County Publisher gets a commission on every item they publish of $10,000 making this a very costly position for the County of Orange. Due to negotiations breaking down the new Orange County Publisher will be under the same contract thus making this appointment later today a lottery of sorts for an over $1,000,000 prize. I am outraged by this and so should our readers. The thought of one County Elected official being the highest paid employee (including all of the publishing commissions totaled up) in the State of California is quite disturbing.

Former OC GOP Executive Director Qualifies For Ballot in SD 16 Special Election

Former Republican Party of Orange County Executive Director George Andrews has qualified for the ballot in the 16th Senate District special election up in the Central Valley. I have already come out and announced my support for George as he would make an excellent Assemblyman. The always grouchy Chris Nguyen has refused to endorse Andrews as of yet claiming that he does not have high enough name ID to be a strong candidate for the seat.

Some of the well-known folks in the party have already had a very positive reaction to the news. I have already taken it upon myself to make my contribution to the campaign both through a check and a free ad on the left side of our blog.

Here are some of the other reactions that I found from some of the recognizable names in politics.

Chandra Sharma: “Two of the presumptive favorites for SD 16, Nicole Parra and Henry Perea, have both announced that they won’t be running for the seat. Sounds to me like no one wants to go head-to-head with George Andrews.”

OC Political Author Allen Wilson: “State Senator George Andrews (R-Hanford, District 16)…I approve!”

CRP Vice-Chair Harmeet Dhillon: “George Andrews for Senate District 16!”

Josh Mann: “Make history and elect George Andrews as the first Indian American to represent California’s 16th Senate District!”

Joel Olsson: “George Andrews, It will be an honor to have you represent me in Sacramento. You are a good man!”

Julie Paule: “George Andrews will make the Republican Senate minority a Super minority. Vote Andrews for Senate.”

The list goes on and on with the support being overwhelming for George Andrews. I am considering temporarily relocating to the Central Valley to volunteer on this campaign in order to help George get elected since this is a swing seat. Councilman Gets Convicted In DUI Case

In the final story I will be running in the Peter Herzog saga he was convicted on Tuesday and although he did not end up receiving any jail time, this puts a major damper on any re-election chances that he may have had.

Lake Forest has recently had a trend of tossing out incumbents over the past two elections with Richard Dixon, and Marcia Rudolph both losing in re-election bids. Mark Tettemer who was the third Councilmember to leave over the past couple of elections chose to leave.

We will have to see what happens in the upcoming election and who jumps in.

LAKE FOREST CITY COUNCIL MEMBER CONVICTED OF DRIVING UNDER THE INFLUENCE OF ALCOHOL

NEWPORT BEACH – A Lake Forest City Council member was convicted and sentenced for driving under the influence of alcohol with a blood alcohol content of .18 percent, more than twice the legal limit. Peter Alan Herzog, 57, Lake Forest, pleaded no contest on Tuesday, March 26, 2013, to one misdemeanor count of driving with a blood alcohol content of .08 percent or more. Herzog was sentenced to first time standard minimum DUI probations of three years of informal probation, fines, and required to participate in a 3-month first offender alcohol program.

At approximately 8:15 p.m. on Nov. 17, 2012, Herzog made a left turn from Portola Parkway onto Lake Forest Drive and drove on the wrong side of the road. Herzog drove over the center median to get back on to the westbound lanes. Herzog then made a wide left turn from Lake Forest Drive onto Regency Lane and hit the right side of the curb. Herzog crossed into the opposing lane of traffic and swerved back and forth across lanes until he arrived at his home.

Motorists reported the driving to the Orange County Sheriff’s Department, who investigated this case, and arrested Herzog at his home. Herzog displayed objective signs of intoxication including bloodshot and watery eyes, slurred speech, a strong odor of alcohol, and unsteady balance. At approximately 10:30 p.m., Herzog had a blood alcohol content of .18 percent.

Irvine Fires City Attorney, Hires Interim & Other Tidbits

In what was a rather interesting meeting yesterday at Irvine City Hall the new Irvine majority City Council continues to make some changes on the administrative side of things. I am quite pleased with the direction that Irvine is heading and am impressed with the fact that the current Irvine City Council majority is trying to cut costs wherever possible. City_of_Irvine_Official_City_Seal_svg

Mayor Steven Choi, Mayor Pro-Tem Jeff Lalloway, and Councilwoman Christina Shea have already  (as the OC Great Park Board) decided to eliminate a contract that was in place with Newport-based Forde & Mollrich. According to an article published in the Orange County Register:

Forde & Mollrich had been paid $100,000 a month until it was reduced to half that, or up to $600,000 a year. In the contract, the firm also was allowed to be called on for up to $300,000 worth of miscellaneous services a year, according to Lalloway’s memo.

At the recent March 21st City Council meeting the decision was made on a 3-2 vote to terminate the contract with City Attorney Rutan & Tucker. This would obviously create a vacancy that needs to be filled. This brings me to the meeting last night and at the meeting last night Irvine had a couple of interesting items on the agenda including item 2.1 which was in the agenda as follows:

2.1 APPOINTMENT  OF INTERIM CITY ATTORNEY

ACTION

1) Authorize the Mayor to execute the agreement attached to  the staff report with the law firm, Jones & Mayer, LLP to serve as  Interim City Attorney.

2) Direct the City Manager to prepare and distribute a  request for proposals for city attorney services so that the Mayor and City  Council may subsequently consider the resulting proposals when selecting a  law firm to provide permanent city attorney services.

3) Authorize the City Manager or his designee to compensate  Rutan & Tucker for work performed by the firm to complete existing work  assignments and enable the transition of assignments to be performed by the  successor attorney(s).

If for whatever reason you are a glutton for punishment and want to read the entire report on this item you can click here. The report is in all honesty pretty important to understand if you want to follow the issue closely.

The other item that I found interesting was expansion of the infamous iShuttle that travels throughout Irvine. This was item 5.1 on the agenda and read as follows:

5.1RECONSIDERATION  OF EXPANDED iSHUTTLE SERVICES

ACTION:
City Council discussion and direction.

I recognize that this description is useless so I have also included the staff report on that item here as well.

The meeting was not on my radar to begin with until I read about it taking place on Facebook. After watching some highlights of the Council meeting on video this morning I was able to get to some of the highlights in order to give brief and somewhat incomplete synopsis of the actions taken last night and a couple of other observations. At the beginning of the meeting it was discussed that the interim law firm in place will be charging fees at a rate that matches that of the previous law firm with the exception of paralegal fees which will be decreased.

The actual vote on approving the new interim law firm was 4-1 which surprised since Agran voted with the majority to go this way, and as you may have guessed Krom was the lone dissenting vote on this. Jeff Lalloway made it very clear that this contract would be put out to bid, which is always good to hear in the name of transparency and open government.

For some reason which I did not catch Beth Krom left the meeting early and was not around for the end of the meeting discussion on the iShuttle expansion. After reading the staff report it was obvious that Agran was the one pushing this item. Agran initially made the motion to move the item and ironically without Krom he had nobody to second his motion. After watching this meeting it is clear that Councilman Larry Agran & Councilwoman Beth Krom do not like being in the minority, Agran did come around on item 2.1 though to appoint the interim city attorney.

This just in from the Orange County Board of Supervisors website. We now have access to resumes and schedules for the interview process. I initially posted a list of OC Clerk-Recorder candidate bios along with statistics and occupations. Yesterday it appears staff at the County decided to take it a step further by posting each applicants resume among other things into a packet that is preparing us all for the epic meeting on Tuesday April 2nd.330px-Seal_of_Orange_County,_California_svg

This was an interesting read to go through all of these applications, cover letters, and resumes in order to figure out how these applicants are angling themselves for the position. Here area few items from the different resumes that stood out.

Larry Bales– He works for used to work for the County of Orange for over 30 years in the office of the Orange County Assessor.

Chris NorbyHe puts OC Supervisor as his position as opposed to CA Assemblyman He lists OC Supervisor as his previous employment with Orange County and mentions that he heard about the job from a County employee/friend. I find it interesting that he listed Supervisor Shawn Nelson (1 of the 5 votes) as another one of his references.

Hieu Nguyen– Other than Renee Ramirez he appears to be the only individual other than Renee Ramirez who has experience working in the OC Clerk-Recorders office. He also heard of the position from a County employee/friend. The one think I liked about his packet was that he included letters of reference from supporters including the very well-known businessman Dale Dykema.

Dick Ackerman– He says that he learned of the job through Newspaper/Magazine and has a number of references he lists including OCGOP Chairman Scott Baugh, CRP Chairman Jim Brulte, OC Supervisor (Ret) Bill Campbell, Senate President Pro Tem Darrell Steinberg, Senate Republican Leader Bob Huff, and Assembly Republican Leader Connie Conway.

Bruce Peotter– As I have stated before he is one of my personal favorites for this position along with Hieu Nguyen. I must admit though that I was surprised with his experience in the office of Public Administrator/Guardian that he applied for Clerk-Recorder instead. His resume/cover letter was the cleanest out of all applicants in terms of formatting and shows that he is extremely qualified for this position.

Harry Sidhu– This one will be tough as long as Shawn Nelson is still a Supervisor next week. In his cover letter he focuses on his private sector experience. In his resume he includes not only his Anaheim City Council experience but also his background as a mechanical engineer, real estate broker, and a business owner.

Michael J. Fox– I was totally hoping to read a filmography on this one but alas my dream was crushed. He learned about the position through Newspaper/Magazine and has a long list of cases he sites as being involved in that shows his background in law is solid.

Steven Madoff– He along with many others in the list learned about the position through Newspaper/Magazine. He is on my list of the most interesting applicants to sit down and have lunch with based on the stories he must have from his years of working for Paramount.

Steven Rosansky– Something is off with this application as he used a totally different application than everybody else that applied for the position. In terms of his cover letter and resume nothing specifically stood out to me other than his experience in Newport Beach as a Councilman, real estate broker, and business owner.

Roy Reynolds– He also states that he learned about the job through Newspaper/Magazine. He included an article that he wrote in the OC Register that referred to his firm conducting polling on behalf of the Costa Mesa Taxpayers Association. Apparently he does his political consulting business as a separate entity from his personal rapid transit consulting which I was unaware of.

Renee Ramirez– In my opinion she went from being the frontrunner to a longshot in a matter of months. She does mention her current occupation as being in the office of OC Clerk-Recorder. She has been employed at the office of the OC Clerk-Recorder since 1991 if I am reading her resume correctly. 2 of her most notable references include former Santa Ana City Manager/Police Chief Paul Walters and Yorba Linda Water Board Member Phil Hawkins.

Starbucks CEO Takes Stand on Gay Marriage Issue

I generally prefer to post about local issues but this caught my eye with the Supreme Court beginning their talks on gay marriage tomorrow.

Frederick E. Allen from Forbes Magazine wrote an article about Starbucks CEO Howard Schultz taking a pretty hard stand in support of gay marriage at the company annual meeting. I will first post the article and give my brief thoughts on this afterwards.

At Starbucks’ annual meeting in Seattle on Wednesday a shareholder complained to the chief executive, Howard Schultz, that the company had lost customers because of its support for gay marriage. Last year Starbucks announced its support for Washington’s state’s referendum backing gay marriage, and in response the National Organization for Marriage launched a boycott of the coffee chain.

“In the first full quarter after this boycott was announced, our sales and our earnings, shall we say politely, were a bit disappointing,” said the shareholder, Tom Strobhar, whom the Huffington Post identifies at the founder of the anti-gay marriage Corporate Morality Action Center.

Was Schultz taken aback? Not in the least. He responded, “Not every decision is an economic decision. Despite the fact that you recite statistics that are narrow in time, we did provide a 38% shareholder return over the last year. I don’t know how many things you invest in, but I would suspect not many things, companies, products, investments have returned 38% over the last 12 months. Having said that, it is not an economic decision to me. The lens in which we are making that decision is through the lens of our people. We employ over 200,000 people in this company, and we want to embrace diversity. Of all kinds.”

At that point the audience interrupted in cheers and applause. Then Schultz concluded, “If you feel, respectfully, that you can get a higher return than the 38% you got last year, it’s a free country. You can sell your shares in Starbucks and buy shares in another company. Thank you very much.” More cheers.

A Washington Post poll this week found that support for gay marriage among Americans has shot up to 58% in favor and 36% against, a complete turnaround in less than 10 years. Schultz’s stand isn’t nearly as daring as it would have been a few years back, but still, it’s impressive to see a CEO think about more than the bottom line and get cheered by his shareholders for it.

Clearly Shultz fears very strongly about this issue and believes in what he is supporting based on his comments. With the looming Supreme Court decision expected this year I expect to hear more from businesses and non-political folks on the issue but I think that this is a huge mistake.

My personal opinions are that businesses should focus on trying to increase revenues in whatever way possible. People who are opposed to gay marriage might continue to purchase products from their but the odds are that some won’t. As an example I recently posted on Facebook that my computer had crashed and a few people recommended that I purchase a service that backs up your data automatically such as www.carbonite.com. I ended up signing up with this service after much consideration due to numerous recommendations and high reviews on different websites from users. A liberal Facebook friend then lashed out about www.carbonite.com being a terrible choice because they advertise on the Rush Limbaugh radio show. It would not have mattered to me whether they advertised on Rush Limbaugh, Rachel Maddow, or Conan I was simply looking for a solid product. Clearly some people are influenced in a negative way by what certain companies do in the political realm.

Starbucks has potentially painted itself into a corner by taking this position. In fairness my opinion does not reflect the specific position that Starbucks took as I have the same issue with Chic-Fil-A who took the opposite stand on the issue. Starbucks should focus on making/selling coffee and Chic-Fil-A should focus on making/selling chicken sandwiches as most people couldn’t care less where they stand on political/policy issues. It’s not like Congress was waiting to hear from Colonel Sanders before they voted on Obamacare.
