Putting Yesterday’s Prop 8 Ruling in Perspective: It Means Nothing Until We Hear from Anthony Kennedy

After yesterday’s ruling from the U.S. Ninth Circuit Court of Appeals, Prop 8 supporters jeered, and Prop 8 opponents cheered.  The news showed jubliant same-sex marriage supporters celebrating the ruling and resolute traditional marriage supporters vowing to appeal.

In the May 2009 California Supreme Court ruling in Strauss v. Horton, the result was the opposite, with Prop 8 upheld.  The August 2010 U.S. District Court ruling in Perry v. Schwarzenegger struck down Prop 8.  Yesterday’s ruling by a three-judge panel of the U.S. Ninth Circuit Court of Appeals in Perry v. Brown upheld the District Court.  Prop 8 proponents have 90 days (well, technically, 89 as of this morning) to decide whether to appeal to an 11-judge en banc panel of the U.S. Ninth Circuit Court of Appeals or to appeal directly to the U.S. Supreme Court.

If there’s any lesson to be learned from all the court battles involving Prop 8, it’s that it doesn’t matter what a particular court rules, the side that wins hails the ruling as a historic victory in defense of the legal concepts they support while the side that loses vows to go to another court.  The only way this cycle ends is to take this to the highest court in the land: only the United States Supreme Court can decide this issue once and for all.

In all likelihood, U.S. Supreme Court Justices John Roberts, Antonin Scalia, Clarence Thomas, and Samuel Alito will vote to uphold Prop 8 while Justices Stephen Breyer, Ruth Bader Ginsburg, Sonia Sotomayor, and Elena Kagan will vote to strike down Prop 8.  This means that whether marriage means one man and one woman or whether it means two people of any sex in California and in America rests in the hands of one man: U.S. Supreme Court Justice Anthony Kennedy.

There’s a certain irony that Kennedy will be the key to this issue, since Prop 8 comes from California, and Kennedy is a native Californian who spent the majority of his life in this state and was appointed to the Supreme Court by fellow Californian Ronald Reagan.  A Catholic educated at Stanford University and Harvard Law School, Kennedy was a lawyer in private practice and has been a law professor at McGeorge School of Law during his time as a lawyer and continuing to the present day.

Kennedy’s judicial track record does not make it clear how he’d come down on this issue.

In Beller v. Middendorf (1980), Kennedy (a Ninth Circuit Court of Appeals Judge back then) wrote the decision that upheld the ability of the U.S. Navy to discharge sailors for “engaging in homosexual acts.”  In Hurley v. Irish-American Gay, Lesbian & Bisexual Group of Boston (1995), he joined a unanimous Supreme Court opinion allowing the St. Patrick’s Day Parade to exclude an Irish gay group.

In Romer v. Evans (1996), Kennedy wrote the decision invalidating a Colorado ballot measure prohibiting sexual orientation from becoming a protected class (protected classes include race, religion, etc.).  In Boy Scouts of America v. Dale (2000), Kennedy voted to uphold the right of the Boy Scouts of America as a private organization to exclude gay men from being scoutmasters.

Both sides of the issue can find favorable parts of Lawrence v. Texas (2003), where Kennedy wrote, “the Texas [anti-sodomy] statute furthers no legitimate state interest which can justify its intrusion into the personal and private life of the individual” but also wrote that the case “does not involve whether the government must give formal recognition to any relationship that homosexual persons seek to enter.”  So Lawrence v. Texas tells us that Kennedy opposed attempts to regulate the conduct of consenting adults but also wanted to make clear that the decision did not affect marriage.

In Christian Legal Society v. Martinez (2010), Kennedy joined a court decision that allowed a public school to refuse recognition to a student group that wished to exclude gay members.

Kennedy’s dizzying array of court decisions leaves little clarity as to how he will rule.  However, there is little doubt that the fate of Proposition 8 and of the definition of marriage in California and America rests in the hands of one Californian above all others: Anthony Kennedy.

Dana Point Takes 1st Step to Ban Plastic Bags! Nanny Government Goes Small Town!

Tonight, by a 4 to 1 vote, the Dana Point City Council voted to implement a plastic bag ban. Of the four Republicans on the council, only Bill Brough voted no on this latest “Green” initiative that is an indirect tax on the citizens via the higher cost of purchasing from retail stores in and around Dana Point. From Lara Anderson, who always wears with pride her endorsements from the Sierra Club, I did not expect a no vote. She is a consistent RINO.

But is was very disappointing to see Lisa Bartlett and Scott Schoeffel vote yes on this extension of big government in our city. But then again they have both voted yes consistently for the Dana Point Hotel Tax so I should not be surprised. They were both endorsed for election (Lisa in 2010 and Scott in 2008) by the conservative South Orange County Republican Assembly. I doubt they will find that group as supportive the next time around with votes like these!

BREAKING NEWS: Tyler Diep Drops Out of Assembly Race

According to the newspaper Người Việt, Tyler Diep has dropped out of the 72nd Assembly District race and will be running for re-election to the Westminster City Council. This comes on the heels of Los Alamitos Councilman Troy Edgar jumping into the race after switching from the 47th Congressional District earlier today. He stated that there was no pressure put on him by any other candidate or political entity to drop out of the race. You can expect to see him endorsing Troy Edgar in the very near future I would guess.

This is a bit surprising though because Diep was leading in the fundraising battle for this race with over $120,000 cash on hand in his account. You can read the story in Người Việt by clicking on the link here. Might I suggest this Google Translate link. The translation is not perfect but it will give you a rough idea of what exactly happened.

The big winner in this would appear to be Huntington Beach Councilman Matt Harper, but I am going to go out on a limb and say that OC Board of Education Member Long Pham actually benefits more from this turn of events. With Diep dropping out, Pham is now the only Vietnamese Republican remaining in the race with a possibility of Harper and Edgar splitting the vote. At the end of the day, though, I would now handicap this race as advantage Harper, assuming he does step up his fundraising.

BREAKING NEWS: Troy Edgar Drops Out of CD 47 Race, Jumps in AD 72 Race

In a surprising turn of events Los Alamitos Counclman Troy Edgar has dropped out of the 47th Congressional District race and jumped into the 72nd Assembly District race. Edgar was the fundraising leader in CD 47 if you count money loaned to yourself ($400,000). This was in a race that included former Congressman Steve Kuykendall and Long Beach City Councilman Gary DeLong.

Realistically this race would have been a tough one for Edgar despite having the fundraising lead because Orange County is a small portion of the new district and on top of that the Democrats have a registration advantage. Having State Senator Alan Lowenthal running on the other side of the aisle does not help things either.

The Assembly race is no picnic either though having to go against Westminster Councilman Tyler Diep, Huntington Beach Councilman Matt Harper, and Orange County Board of Education Trustee Long Pham. However, this is a safe Republican seat and the last one of these guys standing will likely run away with this in the General election when facing off against Joe Dovinh who is likely to make it to the run-off.

I am impressed with the fact that Edgar dropped out of the Congressional race considering he has to walk away from some of the money in his committee that he set up for the congressional race. Los Alamitos is a small part of AD 72 but if Edgar is willing to throw some money at this race I could see him pulling this off.

Todd Spitzer’s Bank Interest Could Fund a Warchest

I am prepared to see Todd Spitzer give Deborah Pauly a little sweet chin music this election, and someone pointed out something very interesting to me about Todd and his committee. Deborah Pauly has an incredible $1,250, which is enough to spend 1/3 of a cent per voter (how would that work?), while Todd Spitzer has over $1,000,000.

If you look closely at his report though you will find that Todd gained a lot of interest on the bank account holding his campaign warchest: about $64,000 of it. This is almost 60 times what Pauly has in her campaign account. While Shirley Grindle is currently busy going after Susan Schroeder, I wouldn’t be surprised to see her propose a new campaign finance law that would outlaw bank account interest.

$64,000 will certainly buy a lot of mail, and it will be awfully hard to combat with Spitzer when the bank interest he accrues could fund an entire campaign on its own. This could become very fun to watch.

Election Day Again: Fatigue is Starting to Set in

Is it just me or is anybody else starting to get sick of these Republican primaries? Today is yet another election day in Colorado and Minnesota.

Colorado- Romney looks like he is going to run away with this one and it should not come as a huge surprise. What does surprise me though is that Santorum appears to be running 2nd in the polls, with Gingrich and Paul about the same. 36 delegates are at stake in this election in a closed non-binding caucus.

Minnesota- Santorum and Romney are polling extremely close to each other for the lead, but Gingrich and Paul are not that far behind. This one will definitely be the most fun to watch in what could end up being a big night for Romney if he wins both. 40 delegates are at stake in this non-binding open caucus.

Plastic Bag Ban Considered by Two Cities

H/T OC Register on the consideration of a plastic bag ban by Dana Point and Laguna Beach. This is not a new story as many cities have already been in talks of passing such an ordinance in Orange County. This is not good news for local businesses in this city as it will be another unfunded mandate for these businesses passed by a government agency. It blows my mind how much time cities waste on such pointless ordinances that have such little impact on te day-to-day operations of city business.

Time could be much better spent on items such as fixing pot holes, cutting wasteful spending, or trying to decrease homelessness. Banning plastic bags which is intended to protect the environment will have a miniscule impact on the actual amount of pollution. Although some bad apples exist that do litter, I would argue that most people do throw away their trash or potentially reuse their plastic bags in a number of different ways.

Whether this ordinance passes or not people will still have a need for plastic bags and will likely go purchase hefty bags from Target and restart this entire cycle. That is until the cities that ban plastic bags in stores also decide to ban the sale of plastic bags as well.

Who is Anthony Stewart Pinkston, and Why is He Carpetbagging into the AD-72 Race?

Yesterday, a fellow by the name of Anthony Stewart Pinkston pulled a signature-in-lieu petition for the 72nd Assembly District.  While obscure candidates often pull papers and even file, Pinkston’s candidacy seems a bit odd.

He has pinkstonforcal.com as his web site on the Registrar of Voters’s Candidate Filing Log, and the whois search on his web site’s domain name reveals that he registered pinkstonforcal.com on January 18, 2012, but it’s registered to a residence in Newport Beach, which is squarely in the 74th Assembly District.  Furthermore, Pinkston’s Facebook profile indicates that he lives in Newport Beach.  Why is a Newport Beach resident running for the 72nd District, which includes Westminster, Fountain Valley, Seal Beach, Los Alamitos, Rossmoor, Midway City, most of Garden Grove, half of Huntington Beach, and a sliver of Santa Ana?

I can’t recall a carpetbagging candidate who wasn’t at least a viable candidate.  We’ve all seen candidates with zero chance of winning run for office, but how often do we see them carpetbag?  Is Pinkston just a crazy carpetbagger, or is he someone’s carpetbagging stalking horse?

Time to show Feinstein the door

Why would someone 78 years old seek re-election to an office that she would hold until she reached 84 years of age?

Good question, but it couldn’t be for the $ 174,000 annual salary she draws from the taxpayers.

Her personal wealth is reportedly between 50 and 150 million dollars all of which is held is blind trust separate from her husbands.

This year Mrs.Feinstein is drawing some challengers.

Al Ramirez, a conservative businessman from Santa Monica has jumped into the race as has Dan Hughes, a conservative businessman from Oceanside who has raised $ 100,000 in the last 30 days.

Elizabeth Emken from Danville is looking to challenge and has already lined up endorsements from OC Republican Assemblymembers Don Wagner and Jim Silva.

Why Democrats keep supporting Mrs Feinstein is a mystery. She co-sponsored PIPA and voted to support the Patriot Act. She’s been in politics since 1978, more than half her life. And with personal wealth in the 100 million range, she’s clearly one of the 1% they loathe.

So will she get rewarded with another 6 years?

Only time will tell…..
