AD 68 Central Committee Mailbox: More Central Committee Madness, Spitzer Hits Pauly

In what continues to be the most absurd Central Committee election that I have ever witnessed, we now have an expensive district wide mailer that went out from the Todd Spitzer campaign hitting Deborah Pauly:

This piece is extremely crafty because even though it went out to AD 68 Republican voters the overlap between AD 68 and the 3rd Supervisorial district is huge. Other ramifications from this piece would be the fact that it may potentially knock her out of the top 6 slots for Central Committee.

I do believe that this piece went a bit far as candidates families should be off-limits. If Spitzer wanted to hit Pauly for poor judgement the evening of the DUI that would have been fine, because clearly what she did was stupid. However, do not mention her husband by name in the piece. I do want to clarify that I do not condone what he did and I am speaking strictly from the point of political etiquette.

In terms of effectiveness this piece will definitely have an impact on the election. Not that it will matter tough as most people appear to think that Spitzer winning is only a matter of time.

Third Supervisorial District: Todd Spitzer in the Mail

Excluding the Anaheim TOT mail (which has nothing to do with the June election), I received my fifth mailer of the primary election cycle yesterday.  The first mailer was from Congressman Ed Royce’s campaign on April 4,  the second one was from Todd Spitzer’s campaign for the Third Supervisorial District on April 19, the third one was another Royce piece on April 28, the fourth one was another Spitzer piece on May 1.  This mailer is the third I’ve received from Spitzer’s campaign, and the fifth I’ve received from any campaign this cycle.

This piece is obviously geared toward Republican voters.

The side with the address label has the two-star Republican elephant along with a large font highlighting Spitzer’s “Local Elected Official of the Year” award 12 years ago from the OCGOP.  It also has a picture of Spitzer with OCGOP Chairman Scott Baugh.  “Todd Spitzer” is the largest font on the page, is part of his campaign logo, and is repeated again in the caption under the picture with Baugh, thereby repeating his name thrice as a way to reinforce name ID even among voters who won’t flip the piece over to read the other side (I guess technically it’s four times since the paid for by message has his name, but that’s in the fine print).

The other side of the piece emphasizes conservative Republican values.  It includes a big CRA logo (with the official three-star Republican elephant) highlighting Spitzer’s CRA endorsement, including a quote from CRA Vice President (and OC Political blogger) Craig Alexander.  The piece also includes bullet points listing Republican stances on taxes, pensions, and crime, along with Spitzer’s membership on the Republican Central Committee and “A” rating from the Howard Jarvis Taxpayers Association.  This side of the piece also repeats Spitzer’s name in large type thrice, again reinforcing name ID even among voters who won’t read the piece and who received the piece in the mail with the address/postage side face down.

A subtle touch is the photo which has a clearly visible North Orange County Conservative Coalition logo on the banner behind Spitzer at the speech he was giving.  A casual reader might not notice the logo.  It does, however, catch the eye of anyone who recognizes the logo.

This is the first mailer from any campaign in quite a while that doesn’t include the needless logos that I admonished campaigns about in this post.

This is the first Spitzer mailer I’ve received that isn’t a four-pager that opens up.  This is a two-sided 8.5″ x 11″ piece.

OC Registrar of Voters News Feed Update: Six Marks the Spot

Editors’ note: Normally we don’t run newsletter reprint in the middle of a Tuesday, but this one is particularly timely.  Biggest piece of news: absentee ballots have not gone out yet; the absolute earliest they could arrive is tomorrow, assuming they start mailing today.  In all likelihood, it will be even later.

Six Marks the Spot

May 7, 2012 – Voting opened today for the June 5th Primary Election. Although we will be mailing out 650,000 ballots shortly voters can vote in our office in Santa Ana, and six did so today. It may not sound like a large number, but we have had a small turnout on the first few days of voting, only to grow into larger turnouts later in an election. In addition to our six in-person voters we have had 224 military and overseas voters return their ballots to date

Sample Ballot: Bob Huff Not Endorsed by California Republican Party

The Orange County Registrar of Voters reports that the Republican Party issued no endorsement in the 29th State Senate District race.

This is utterly preposterous.

The only two candidates running in SD-29 are Democrat Greg Diamond and Senate Republican Leader Bob Huff.

Though some people have stated that Huff is “a bit of a squish,” the fact of the matter is that political parties always endorse their party leaders for re-election.  If you don’t like the leader, you dump him from his leadership post long before you try to dump him from his legislative seat.

Regardless, I know Huff was endorsed because I saw with my own eyes that he was endorsed  on the Orange County Republican Party’s consent calendar.  Furthermore, the California Republican Party publicly announced its endorsement of Huff.

Is there much of a political implication for this error?  Probably not since SD 29 has such lopsided registration.  However, if this had happened in a seat with much closer registration numbers, this could have been really bad.

Whose fault is this error?  Clearly, this clerical error could only have happened in one of three places: CRP, OCGOP, or ROV.  This error rests with the CRP because Huff was not listed as an endorsed candidate on the LA County sample ballot either.  (The odds of two county ROVs making the same mistake are highly unlikely.)

Right now, I would not want to be the person at the California Republican Party who left the Senate Republican Leader off the endorsement list sent to the county Registrars.

(Tangential note: interestingly, the American Independent Party endorsed Huff.)

Stanton: Vote For Tax Increase Or Become An Island

In a carefully worded letter found on the City of Stanton website it appears that scare tactics are being used to try to get voters to pass a tax increase. The letter from City Manager Carol Jacobs read as follows:

Dear Stanton Resident;

The City Council has asked me to update every concerned resident about the future of our city. Our city is faced with severe economic realities and there are important decisions facing every Stanton citizen.

What brought us to this situation?

Last spring, the City Council was forced to declare a “fiscal emergency.” That declaration was necessary because politicians in Sacramento have taken our local taxpayer money to fund the state budget. The resulting shortage of funds has put Stanton at risk in order to compensate for severe budget deficits.

The national recession has also hurt Stanton. Stanton residents lost jobs and are spending less, resulting in a decline in local tax revenues

Look at the actual numbers:

• Sales tax revenues will be lower in 2012 than revenues produced nine years ago in 2002.
• Sales tax has fallen $1.2 million (30%) since 2006-07.
• Property tax revenues for 2012 will be lower than property tax revenues produced seven years ago in 2004.
• Motor Vehicle License Fees have decreased 9.4% since 2007.
• The City of Stanton receives less than 1% of the 8.75% sales tax percentage and only 11 cents out of every property tax dollar.

This reduction in revenue has created a budget deficit of $2.8 million a year, estimated to grow until the City’s reserves are depleted in 2016.

What is the City Council doing about it?

Faced with these realities the City Council has made drastic cuts to the budget that affect all of us. Since 2008, many good programs have been eliminated.

• Closed two city parks and decreased park maintenance in all remaining parks.
• Graffiti abatement and code enforcement have been reduced.
• City funding for school crossing guards and afterschool programs have been eliminated.
• City Hall is closed one day a week.
• Police services have been cut.
• Many Parks and Recreation programs no longer receive needed taxpayer money.

The City Council has studied the economic realities and have concluded that the budget can not be downsized any further without risk to Stanton residents and their property.

What can you do to help?

Your City Council has placed a measure on the June ballot to improve the financial situation. I can not ask you to vote “Yes” or “No” on this Measure, but I can tell you what it will do. If the June ballot measure is passed, an additional $1.2 Million will be generated to provide public safety and other vital city services.

The choice for Stanton residents was never clearer. If we do not find an additional $1.2 million in revenues, the city faces bankruptcy and Stanton would become an unincorporated “island” of the County of Orange. This would likely result in fewer services, especially police, fire and paramedic services.

If the measure fails, local businesses that provide jobs and boost our economy may find new cities where they believe their property and personnel will be safer. Even worse, new businesses planning on locating in Stanton and improving vacant industrial and retail property, may not re-locate here if they believe our town is not safe or its future is uncertain.

I hope this information has been helpful in explaining the economic realties facing Stanton, what is being proposed to remedy some of the shortfalls, and the potential impact of continuing shortfalls. In other words vote for the tax increase or Stanton will join Gilligan and the Skipper on an island. In other words, Stanton would cease to exist and become a County island. I am not surprised to see public administrators advocating for this tax increase, but this is pretty brazen on their part to try to scare voters into increasing taxes.

I will give them credit, this letter does not appear to violate any campaign laws due to careful wording. It pushes voters to vote for the increase without actually coming out and requesting a yes vote on the measure.

This measure will likely face a lot of skepticism, as voters are very uneasy about tax increases in the current economy. It may at the end of the day pass, but this scare tactic employed by the city is a bit disappointing.

Proposition 29 is Taxpayer Waste Waiting to Happen

The June primary is nearly, and the debate over Proposition 29 grows more intense, not surprisingly since it is about the only major issue on the ballot.

Predictably, proponents are trying to focus attention on the “No on 29” being funded by the Big Tobacco bully that only cares about the potential threat to its profits. But voters aren’t stupid and can figure that out for themselves.  After all, when Proposition 10 was in the ballot in 1998, the tobacco companies were up front in their ads about their leading role against that tobacco tax, and with that issue out of the way, they focused on their policy arguments against Prop. 10.

And it nearly worked: Prop. 10, a “sin” tax to fnd early-childhood development programs, barely passed at a time of great economic growth in California (remember when we had prosperity?).

Prop 29. taxes on something bad (cigarettes) for something good (cancer research). But there are broader policy issues in the fine print that voters ought to be concerned about. Voters should question the sincerity of its laudable goal — cancer research — when you learn that this measure creates a new 9-member board composed of political appointees that would have complete control over how $735 million in new taxes are spent with no accountability to the public.

Despite the best intentions of its supporters, examples of questionable management have emerged since Prop. 10’s passage. When you consider that Prop. 10 was a better crafted measure with more built-in accountability, and that Prop. 29 imposes literally no transparency and accountability on the very people providing the funds, we can have zero confidence Prop. 29 won’t result in the abuse of tax money.

And if that doesn’t convince you of the bad policy in this measure, just read this editorial from the LA Times. You would expect that one of the most liberal publications in the country would be more than eager to stick it to the tobacco industry, but even the LA Times editorial board acknowledged this flaw and encouraged a no vote.  The last thing we need in California is another government entity using taxpayer dollars to serve their own self interests. It’s no wonder politicians have a reputation for being crooked and dirty. Voters need to put the kibosh on Prop. 29.

OCBE 3 Mailbox: Williams In The Mail & Press Release

In the Orange County Board of Education, Trustee Area 3 race Ken Williams has had the first mailer go out to voters today (Full Disclosure:Custom Campaigns is the lead consultant on this race).

It is always tough to do mail in a race for a seat that is the size of a County Supervisors but draws far less attention. Here is the mailer which is on a 8.5 x 5.5 size piece of cardstock:

Santa Ana City Council Campaign Contribution Law

Tonight the Santa Ana City Council is going to, more than likely, vote to remove a restriction on campaign contributions and loans and the effect they play on how our Councilmembers vote.

 California Government Code and the Political Reform Act, along with Santa Ana Charter, require that elected officials abstain from voting on any matter where the official received a campaign contribution of more than $250 in the 12 months immediately preceding a vote. In November 1996, Ordinance NS 2034 was adopted by the City Council which imposed an additional restriction prohibiting a Councilmember from soliciting or accepting campaign contributions or loans of more than $250 for a period of three months following a vote.

 The current sitting Santa Ana City Council has been plagued with controversy over Councilmembers voting on matters for which they have  received campaign contributions. Back in 2010, Councilmembers Sal Tinajero and Michele Martinez received several thousand dollars in campaign contributions from companies with a financial stake in a land project called the Station District. Without their votes the council did not have the votes to approve the project.  The contributions came both before and after the vote.

 This was in direct violation of the state and city laws discussed above, and when exposed, the Councilmembers returned the contributions, but the vote had already been cast. The legally correct thing to do would have been to undue the vote and sanction or fine the Councilmembers that illegally voted, but our City Council claimed it was too late to undue the contractual commitments made. A contract illegally entered into is void, and that is what should have occurred, but our Council once again failed to do the right thing. 

 Tonight our City Council is going to try and make things right by simply making the law that makes what they do illegal, go away. So if we stop saying that robbery is illegal then it’s okay for us to rob and be robbed – right? 

 Wrong!  A rose by any other name is still a rose; and the practice of putting your vote out for sale is wrong.  Santa Ana City Councilmembers are very arrogant in the positions of authority that they have been elected to and have repeatedly said “Hey, if you don’t like it – vote me out.” Well, I agree with that statement and I urge the Santa Ana Voters to do just that this November.
