Petrilla’s Past: Felony Assault With A Firearm – an Important Article by Martin Henderson at RSM Patch

Tonight I read a very disturbing news article by Martin Henderson of the Rancho Santa Margarita Patch (http://ranchosantamargarita.patch.com/) about RSM City Councilman and 73rd Assembly District candidate Jesse Petrilla. According to the article, (Petrilla’s Past) in 2001 Mr. Petrilla pleaded guilty to assault with a firearm and another felony charge with a firearm enhancement. Apparently in 2004 the charges (after he served his probation) were reduced to misdemeanors and dismissed.

According to the article, when contacted by a Patch reporter, Mr. Petrilla apparently had no time to discuss this with the reporter.  Given that Mr. Petrilla wishes people like me (who live in the 73rd Assembly District) to vote for him to be my representative in the Assembly in Sacramento, I find this news disturbing, more so when he has “no comment.” I hope he has a better explanation that this for the voters.

Note: it was brought to my attention that I used the term “parole” instead of “probation” to describe part of the sentence the judge gave to Mr. Petrilla.  That was my error and I stand corrected.  I have changed the description to probation.

The Brown Act Does Not Allow “Closed Session” Discussions by a Public Entity On Project Labor Agreements

As Chris Nguyen reported in the two previous posts, I have the honor of representing Rancho Santiago Community College Board of Trustee member Phillip Yarbrough on the issue of the use of “closed sessions” by the Board of Trustees to discuss Project Labor Agreements. As I reviewed the Brown Act including the Appeals Court decisions and the Attorney General opinions on this subject, it became very clear to me that a public entity that is subject to the Brown Act, is not allowed to hold “closed sessions” of the Board meetings to discuss Project Labor Agreements. This issue is complicated in its legal explanation and Chris attached a copy of the letter I sent to the Chancellor and the Board President last week explaining my conclusions to them.

For those of you not familiar with the Brown Act – the Ralph M. Brown Act makes it a requirement that a local public entity must hold its meetings in open sessions where members of the public may attend and address the board on subjects the Board is dealing with in that meeting. There are some expressly stated exceptions to that rule that authorize the board to have “closed sessions” where the public may not listen to the board’s discussions on those topics. In short, the topic of Project Labor Agreements is not one of the authorized subjects for discussion in closed session. Thus any discussions on PLAs must be held in open session. The Board of Trustees did the right thing tonight by voting to hold all future meetings on this topic in open session.

WHY DOES THE TEACHERS UNION LOVE ANNA BRYSON?

State Assembly Candidate Anna Bryson – The Unions’ Favorite GOP Candidate!

When Anna Bryson first ran for election and then re-election to the CUSD Board of Trustees I was one of those who endorsed and supported her. After the 2010 elections, many of my friends who also supported her and I were aghast that she so blatantly switched sides and voted with the Trustees who were elected by the teachers and classified unions.  She is seeking to replace my current Assemblyperson Diane Harkey who is termed out in 2014.  As a resident of South Orange County, I am one of those taxpayers directly affected by her votes and I have no desire to have her as my “representative” in the State Assembly.

The examples below are drawn from the agendas and minutes of the CUSD or from newspaper articles that report on Ms. Bryson’s votes on key issues at Capistrano Unified School District. I always have believed that a politician’s voting record is the very strongest evidence of where their core values lie. In my opinion, Ms. Bryson’s voting record is evidence that her core values do not lie with the taxpayers.

• THE TEACHERS UNION RECEIVED A $30,000,000 “PAY RESTORATION”
12/07/2010 During a closed session of the Trustee board it appears a majority of the board voted to give the teachers union approximately $30,000,000 in compensation restoration which was not on the agenda for that closed session (which resulted in an investigation by the Orange County District Attorney).

This Saturday, October 12, 2013 at 7:00 p.m. local residents will be gathering at the home of patriot Joyce Hicks (22541 Tindaya, Mission Viejo, CA 92692) to support Laguna Niguel Mayor Robert Ming’s campaign for 5th District Supervisor of Orange County. Our current Supervisor Pat Bates is termed out next year (Pat is running for State Senate).

Mayor Robert Ming has a solid record of Constitutional conservative governance and activism. During his time in office, Robert helped cause Laguna Niguel to build their City Hall with absolutely no debt or higher taxes. He has a solid voting record against higher taxes and fees in his city and he opposed the use of redevelopment crony capitalism long before the state ended the practice.  He is a founder of the Association of California Cities – Orange County a conservative alternative to the League of Cities and he still serves on its board of directors.

Robert has been endorsed by the Lincoln Club of Orange County and Atlas PAC.

Sen. John McCain – Obamacare Rubber Stamp man

I have long felt that John McCain is neither a conservative nor a liberal but a politician of the Party of John McCain. He goes off on his own tangents sometimes advocating a position I agree with but most often not.

However his performance in the Senate this week and the statements he made about Sen. Ted Cruz and Obamacare were over the top and I believe a fundamental disconnect for him from his role as a Senator from Arizona. Rather than just quietly voting for the close of debate after Sen. Cruz finished his filibuster, Sen. McCain essentially stated on the Senate floor that because President Obama was reelected we just have to accept Obamacare as is. Ben Shaprio over at Breitbart has a short and well written post about this at http://www.breitbart.com/Big-Government/2013/09/25/McCain-bashes-Cruz I recommend it to you.

As Mr. Shaprio noted, I guess the people of Arizona did not know they re-elected John McCain to not advocate legislation to fix or replace Obamacare but just accept it as is. And to call how the bill was passed “fair” is to ignore history. In addition Sen. McCain is giving a pass to President Obama for all of his unconstitutional exemptions and postponements of Obamacare’s requirements to big business, labor groups, anyone working inside the Capital dome but not the American people (no exemption of the “individual mandate”). These types of edicts / exemptions by President Obama are more in line with a banana republic than a country where the elected leaders respect the rule of law and U.S. Constitution. Sen. McCain should have been challenging the President and the Democrats over these unconstitutional edicts and not rubber stamping those actions by going a long with Harry Reid.

What Sen. Cruz was doing was not just about Obamacare (which is bad enough) but about whether we as a people are going to push back against a President who rules by edict and ignores and flaunts the U.S. Constitution. Sen. Cruz was calling the President out on this as well and Republican Senators should have been joining him in at least adding their voices against this threat to the rule of law!

I hope the people of Arizona are seeing this and will find a better representative when Mr. McCain is up for re-election.

The California Republican Assembly Publishes the 2012 CRA Legislative Scorecard

There are a lot of legislative score cards out there.  In my opinion the best one for an overall view of your legislator’s voting record and a variety of subjects is the one put out by the California Republican Assembly (disclaimer: I am a Vice President of the CRA).  The scorecard is put together by a team of volunteers that is headed up by CRA Vice President Tom Hudson.

An Excellent Commentary about the Chick-fil-A Controversay by Walter Myers III

There has been a lot of press about the comments by the President of Chick-fil-A in support of traditional marriage.  Once again it seems those who are in favor of homosexual marriage are a very tolerance people – as long as you agree 100% with their point of view.  As usual the liberals are all for the 1st Amendment’s freedom of speech – as long as it is politically correct speech!

Dr. Ken Williams and Robert Hammond Sworn in as Trustees for the Orange County Board of Education

Today I had the honor of attending the swearing in ceremony of Dr. Ken Williams and Robert Hammond for their terms on the Orange County Board of Education. For those who are already familiar with the OCBOE, you know that Dr. Ken Williams has been a conservative voice on that Board for many years. I was glad that Dr. Williams not only won re-election but by a large majority of those voting in his Trustee area.

Robert Hammond is the new comer to the Board having just won his election on June 5th. Robert had a tough race against several opponents but he worked very, very hard to reach out to the voters in his Trustee Area and it paid off in his win on Election Day. Robert will be a strong conservative voice on this Board and I am encouraged by his election as a Republican in an area that has many Democrats and Decline to State voters.

What might not be so well known is our publishers Chris Emami and Chris Nguyen of Custom Campaigns were the campaigns managers for both Dr. Williams and Mr. Hammond. They did a great job of planning and executing successful election and re-election campaigns on shoe string budgets. With these two successes and their past successes with other school board races, Custom Campaigns is becoming the go to group for getting elected to a school board in Orange County.
