BREAKING: Anaheim Reaches Agreement with Federal Government for Investigation of APD

Over the weekend, Anaheim Mayor Tom Tait contacted the U.S. Attorney’s office and the State Attorney General’s office to ask that they launch full, independent investigations of the Anaheim Police shootings.

The federal prosecutors at the U.S. Attorney’s office told the City they would be willing to investigate.

Just moments ago, the Anaheim City Council voted unanimously to accept an offer from the U.S. Attorney’s office to conduct a “full investigation” of the Anaheim Police’s officer-involved shootings.

This is in addition to the Council’s action last month to have the City Manager hire an outside investigator to examine the Anaheim Police Department’s officer-involved shootings.

Fountain Valley Councilmember Pulls Papers To Run Against Incumbent

In a bit of a surprise yesterday Fountain Valley Councilmember Larry Crandall pulled papers yesterday to run for the Municipal Water District of Orange County, Division 3 against appointed incumbent Wayne Osborn. The seat was vacated by Ed Royce Sr. former Stanton City Councilmember and father of Congressman Ed Royce. In March Osborn was appointed to fill the vacancy and it should be noted that he has also pulled papers to run.

Not to confuse our readers but it is important to clarify that this is the Municipal Water District of Orange County (MWDOC) which is different from the Orange County Water District (OCWD). For those of you that were wondering Boardmembers in MWDOC are:

Division 1- Brett Barbre
Division 2- Larry Dick
Division 3- Wayne Osborn
Division 4- Joan Finnegan
Division 5- Wayne Clark
Division 6- Jeffrey Thomas
Division 7- Susan Hinman

Boardmembers on the OCWD are:

Area 1- Kathryn Barr
Area 2- Denis Bilodeau
Area 3- Roger Yoh
Area 4- Philip Anthony
Area 5- Steve Sheldon
Area 6- Cathy Green
Area 7- Shawn Dewane
Area 8- Claudia Alvarez (Appointed Santa Ana Seat)
Area 9- Harry Sidhu (Appointed Anaheim Seat)
Area 10- Don Bankhead (Appointed Fullerton Seat)

This will be an interesting race because although incumbency is a powerful tool being a Councilmember is also a very strong position to be coming from for any seat. Larry Crandall won’t necessarily return his papers though as often officeholders will pull papers as a way to scare others out of a race i order to clear the field for someone who they are supporting.

Many people who are in Republican Party circles know Larry Crandall in his capacity as a Councilmember in Fountain Valley and his work with OC Supervisor John Moorlach. It appears that if he goes through with this run that he will be giving up his City Council seat to do so, unless he decides to run for both (Never a good idea).

Not as many insiders are as familiar with Wayne Osborn who is also a Fountain Valley Republican. Chris Nguyen will be displeased to learn that his Bachelors is from UC Berkeley but that may be offset by the fact that his Masters is from USC. Here is his full bio from the MWDOC website:

Wayne Osborne was appointed to the Municipal Water District of Orange County (MWDOC) Board of Directors in March 2012. He represents Division 3, which includes the areas of Cypress, Fountain Valley, Los Alamitos, Stanton, Westminster, the western portion of Garden Grove, and nearby portions of unincorporated Orange County.

Director Osborne has a long history of commitment to the water industry.  He worked for the City of Fountain Valley for 33 years as the Director of Public Works and City Engineer.  During that time, he developed the City’s water supply master plan, implemented long-term capital improvement programs for water supply, and oversaw the maintenance of all public works facilities, including water and wastewater systems. He was also instrumental in obtaining grant funding for construction of two wells and other key water infrastructure.

Director Osborne is a member of several water industry organizations, including the American Water Works Association and the Orange County Water Association, of which he is a Past President.  He is also an active member of professional organizations, including the American Public Works Association and the Orange County City Engineers’ Association, of which he is also a Past President.

Director Osborne received his Bachelors degree in Civil Engineering from the University of California, Berkeley, and his Masters Degree in Civil Engineering from the University of Southern California. A longtime resident of Fountain Valley, he is married to his wife Mary and they have four children.
This division appears to cover Westminster, Los Alamitos, Garden Grove (portion), and Fountain Valley. With these 2 candidates potentially splitting the Fountain Valley vote and the incumbent vote it will be interesting to see if somebody from Westminster (the largest city in the division).

We still have a few weeks left in filing and many of the questions we still have should be answered by August 10th when filing closes.

It appears that the Yes on 32 Campaign is gaining some bi-partisan support based on their press release. In the effort of full disclosure Custom Campaigns is doing consulting work for Yes on 32. Here is the press release:

Santa Ana City Council To Discuss Term Limits Monday

Apparently the City of Santa Ana is going to be discussing term limits at their meeting on Monday. We here at OC Political have received a tip that item 85B on the agenda will be discussed. The item was agendized by Councilwoman Michele Martinez and is titled “DISCUSSION OF POTENTIAL BALLOT MEASURE REGARDING MAYORAL AND COUNCIL TERM LIMITS.”

Information is limited at this time as to specifically what the Santa Ana City Council will be discussing with regards to term limits, but this should make for an interesting topic of conversation with all of the recent buzz.

In a recent article that I posted here on our blog, I discussed a lawsuit that was filed by Parks & Recreation Commissioner Max Madrid. The lawsuit is looking to allow Councilwoman Claudia Alvarez run for a 4th consecutive term. Chris Nguyen has speculated that the lawsuit may get thrown out due to Madrid does not have sufficient standing to bring the suit forward.

Tensions will be high at this meeting with the recent arrest of Councilman Carlos Bustamante, what looks to be a very long agenda, and Councilwoman Claudia Alvarez looking to be out of office in the very near future. My though is that discussing term limits will likely not be the most friendly part of this meeting.

Lawsuit In Santa Ana Over Term Limits

According to the Orange County Register it appears that the City of Santa Ana is going to have a Judge determine whether or not Councilwoman Claudia Alvarez run for a 4th term. She is currently finishing up her 3rd term and needs a ruling quickly on this with filing opening up on Monday for this seat.

This lawsuit comes as a result of the passing of Measure D in Santa Ana back in 2008 which extended it from 2 consecutive terms to 3 consecutive terms a Councilmember can serve. Apparently Santa Ana has a rule that you must sit out 8 consecutive years after you finish your 3rd term (This seems extremely draconian compared to other cities).

It is important to note that the lawsuit has not been filed by Alvarez herself, but instead by Max Madrid a Parks & Recreation Commissioner appointed by Alvarez. Rancho Santa Margarita City Councilman Steve Baric (Vice-Chairman of the California Republican Party) is the attorney on behalf of Madrid on this case.

Based on the way Measure D is written the only change made to Section 401 of the Municipal Code was a simple change to simply the number of consecutive terms a Councilmember can serve. With no other changes being made by the measure it will make it tougher to argue a loophole.

The argument being made by the proponents of the lawsuit appears to be that with the passage of Measure D the term limit count on each Councilmember was reset. I will let you make your own judgement on the interpretation of section 401:

Sec. 401. – Qualifications of members.

To be eligible to be elected to the office of councilmember, a person must be a qualified voter and a thirty (30) day resident of the ward from which the candidate is nominated at the time nomination papers are issued as provided for in the Elections Code of the State of California, except that the mayor need only be a registered voter and thirty (30) day resident of the city at such time. In the event any councilmember other than the mayor shall cease to be a resident of the ward from which the councilmember (or, in the case of an appointee, the councilmember’s predecessor) was elected, or in the event the mayor shall cease to be a resident of the city, the office shall immediately become vacant and shall be filled in the same manner as herein provided for other vacancies; provided, that where a councilmember ceases to be a resident of the ward from which the councilmember (or, in case of an appointee, the councilmember’s predecessor) was elected solely because of a change in boundaries of any ward as in this charter provided, the councilmember shall not lose the office by reason of such change. If a member of the city council shall be convicted of a crime involving moral turpitude, the office shall immediately become vacant and be so declared by the city council.

A person who has served three (3) consecutive terms of four (4) years each shall be eligible for appointment, nomination for or election to the office of councilmember (regardless of wards represented by that person during such period) no sooner than for a term beginning eight (8) years after completion of that councilmember’s third consecutive full term.

Short or partial terms shall not be considered in determining eligibility for appointment, nomination or election. For purposes of this Charter, short or partial terms shall only be those where the councilmember was elected or appointed to replace another councilmember who left office before the latter official’s term expired. Any councilmember who assumed office at the beginning of a term and left office early for any reason whatsoever shall be deemed to have served a full term.

Interestingly this section also points out what will happen to Councilmember Bustamante should he be convicted of the crimes he has been accused of. My interpretation of the section is clear that once you have served three consecutive terms you are termed out. It is not up to me though, as we will have to see what the court says.

Creating Wards In Anaheim Would Be A Mistake

It has been brought to my attention that some misinformed people are pushing for a system that would separate Anaheim into different wards for the City Council races. I will disclose up front that I am a resident of Anaheim Hills and an appointed member of the Anaheim Housing Commission. The concept of putting wards in place is simply a waste of time and resources.

Only 3 other Cities use a Ward system in Orange County (Santa Ana, Newport Beach, and Seal Beach) and Santa Ana has a bizarre system where the entire City votes for the Councilmembers despite the fact that they have to live in the wards.

Anaheim currently has 4 members of the Council (including the Mayor) that live in Anaheim Hills and one minority on the Council. These members were all fairly elected to the Council by the entire City, whether you like them or not they and according to the 2010 Orange County Registrar of Voters Statement of Votes Kris Murray, Gail Eastman, and Tom Tait all won the area covered by the Anaheim Union High School District (http://www.ocvote.com/fileadmin/user_upload/sov/gen2010/sov-web.pdf).

Lets take a look back at the winning candidates for Anaheim City Council/Mayor going back to 2002:

2002- Curt Pringle, Bob Hernandez, & Richard Chavez (All 3 did not live in Anaheim Hills)
2004- Lorri Galloway & Harry Sidhu (Both do live in Anaheim Hills)
2006- Curt Pringle, Lucille Kring, &  Bob Hernandez (Only 1 lived in Anaheim Hills)
2008- Lorri Galloway & Harry Sidhu (Both do live in Anaheim Hills)
2010- Tom Tait, Kris Murray, & Gail Eastman (2 live in Anaheim Hills)

These numbers show that both candidates from Anaheim Hills and the flatlands win races for the City Council and Mayor. It is not some conspiracy that has been put together to keep candidates on the City Council that only live in Anaheim Hills as 2010-2012 is the only time frame i the past 10 years where we have seen 4 Councilmembers living in Anaheim Hills.

Voters should  have a right to vote for the best candidates running for City Council regardless of where they live and what race that they are. In my opinion this not only should be the rule for Anaheim but any City including Santa Ana, Seal Beach, and Newport Beach.

Arguably the 2 front-runners for Anaheim City Council in November are Lucille Kring and Steve Chavez-Lodge (neither on lives in Anaheim Hills). Much like the stock market Councilmembers in terms of where they live are cyclical. Sometimes candidates from the flatlands win and other times candidates from the hills win.

I can’t believe that I am saying this but one of the better articles that I have seen on statistical reasoning against switching to a ward system comes from Gustavo Arellano at the OC Weekly who penned this http://blogs.ocweekly.com/navelgazing/2012/06/aclu_anaheim_lawsuit_latinos.php. He and I may not agree on much in terms of policy but he absolutely hit it out of the park with this story even though I don’t agree with some of the ways he expressed his position in the article.

Hopefully the system in Anaheim stays the same and we can continue to simply vote for candidates that will represent all of Anaheim not just their specific wards.

Police Conflict Brewing in Brea

In a story that looks like it could have come from The Maury Povich Show, a conflict appears to be brewing between the Brea Police Department and the Orange County Sheriffs Department.

H/T to reader Allen Wilson who sent me this flyer that is apparently being passed around at supermarkets in the City of Brea:

Clearly the Orange County Sheriffs Department already has the upper hand with the decision being made by the Yorba Linda City Council to give them the contract. This is actually a wise tactical move to ensure that enough pressure is applied in Brea to stamp out any threat to the contract.

Brea Councilmembers are obviously going to be worried about their own city in an election year and will unlikely push the issue further for fear of losing votes in November. The political season is upon us and decisions are often weighed carefully by consultants on what impact it will have on voters.

With the Brea PD going up against the OCSD though it should make for an interesting November election both on Yorba Linda and Brea.

Live Blogging: Central Committee Meeting 6-18-2012

7:02 PM- Nguyen is driving the OC Politicalmobile on our way to the meeting which has been moved to Skosh Monahans in Costa Mesa.

7:17 PM- We have arrived at the meeting a few minutes late.

7:19 PM- They are now in the process of appointing a financial review committee which will consist of a member from each Assembly District Committee.

7:23 PM- I just learned from fellow OC Political blogger Craig Alexander that Bill Dunlap has been appointed to replace the seat held by former party chairman Tom Fuentes.

7:27 PM- John Warner voted in as the new 1st Vice Chairman.

7:30 PM- Speech is being given by John Warner thanking members and talking about working together to move forward.

7:32 PM- John Warner now giving his first report as 1st Vice Chair, talking about Flag Day. Mary Young now giving her report on voter registration efforts.

7:34 PM- Bills are all paid and no ethics committee complaints during the June election cycle and meeting appears to be coming to a close.

Orly Taitz Blames Voting Machine Fraud For Her Loss

H/T to Martin Wisckol of the OC Register Total Buzz blog for posting an article about Orly Taitz claiming that birther lawyer Orly Taitz is suspecting election fraud in her loss to quite a few opponents in her race for top two for United States Senate. The result was that Dianne Feinstein and Elizabeth Emken will face off in November for the Senate seat.

Chris Nguyen even questioned why Orly Taitz never released her naturalization certificate in light of the fact that Mitt Romney and Barack Obama both released their birth certificates.

It turns out that I actually saw this news story as well last night, when voting machine DRE 700 won the Presidential race. Take a look at the news story:
