BREAKING NEWS: Complaint Filed With Office Of The District Attorney Against Brett Barbre

OC Political was tipped off today by an anonymous source that a complaint was filed with the office of the District Attorney against Brett Barbre. Barbre who is one of the consultants working on the Troy Edgar campaign is accused of falsely signing that he gathered nomination signatures on a document that somebody else circulated. Here is a copy of the letter that was sent to the Office of the District Attorney:
We will report more on this story along with the pending lawsuit to get Troy Edgar back on the ballot as soon as we get more information.

Well. Chris, don’t hold your breath the DA will investigate. As with most political violations, Tony will assess the situation based on his personal political aims and then dispose of the complaint with a curt notice to the complainant, whoever that may be.

The unidentififed woman mentioned in this article is clearly Nicole Stygar, staffer on Edgar’s disastrous attempted run for Assembly. She’s kind of hard to miss.

So, here is the question that I haven’t asked at losalnews.com because I am not an attorney, nor do I play on on the Internet.
1) This letter is now in the public domain.
2) Is Kelly now required to watch the videotape and see if it shows what the letter claimed?
3) If Kelly does review the tape and it does show what is claimed, is Kelly required to file a complaint with the DA for violation of Election Code 104?
4) My understanding (from when I ran for Congress back in the mid-90’s) is that if the signature on the signature gathering page is found to be invalid, then all the signatures on that page are also invalidated. If that is still the case and the claim invalidating the signature of the gatherer is found to be accurate, wouldn’t this mean that Edgar’s nomination petition was well below the required signatures to be considered?
I ask this here as there are attorneys that actually follow this blog (unlike losalnews.com where we don’t generally deal with esoteric things like election law). I would love to be enlightened by someone who does know the legal ins-and-outs as to what Kelly is required to do, what he may do, and how that would effect the nomination papers (although Case ID: 30-2014-00710804-CU-WM-CJC is scheduled with an Order To Show Cause on 3/27/2014 at 9AM in Department C18 before Judge Claster, so the points may be moot by as early as 10AM).
